on june 6 dos ammended their june visabulletin by adding a new category for nurses (schedule - a) and making it as 'current'. that means, all wait is over for nurses now and gates are re-opened officially on june 6th.

as the regular readers of allnurses.com know, this thread can be connsidered as the continuation of the thread "worst news for rns from india, phili..." (click here to view that thread : https://allnurses.com/forums/showthread.php?t=87149). worst news thread was started when darkness and gloom hit intl. nurse community when dos announced (dec 11 2004) the retrogression for nurse immigration from these 3 countries.

Ahh ok sorry for that rossario. Ok i get it now, your friend was delayed because of retrogression itself that was shut down as early as OCtober 2004 as i believed. I think the majority of nurses from other forums that I have read holds a PD around 2004. So as mentioned by some here NVC people has still no idea about Schedule A being current. If guidelines would be established this month probably cases would be moving in July.There is an "UNCONFIRMED" report from reputable sources that the Department of State is planning to SHUT DOWN the processing of the ENTIRE EB3 worldwide and even EB1 and EB2 on the final quarter to give way for the processing of Schedule A in the final quarter of the fiscal year that would start on July 1 and ends at September 30, 2005.
So brace yourselves for the adrenalin rush that is about to come! It will be a superhighway for the processing of Schedule A...

I said that there are unconfirmed reports that EB3 will be UNAVAILABLE worldwide on the last quarter of the Fiscal Year 2005 that would start on July 1, 2005 until September 30, 2005. When this happends only Schedule A can be processed by the NVC. During this time if EB3 will become available during these 3 months the Schedule A can take of the advantage of using the 50k visas. I did not say 50k visas will be exhausted by September 30, 2005. It means that Schedule A cases would be on the "SUPERHIGHWAY" at the NVC because they would not be processing other EB3 cases. So its only Schedule A that would be concentrated on.
Did you get me? Is it clear now?
Because based on the law, October 1, 2005 will mark the first quarter of the U.S. Fiscal Year 2006, and visas for employment based categories would open up again for the EB3.

what is the date today? june 13. and there are still no updates on how nvc would process pending cases. so everybody expects that guidelines would be formulated around july 1, 2005. right?

assuming if they would start processing cases starting july 1, 2005...they have approximately 90 days or 3 months to clear the pending backlog that was created by retrogression. right?
in simpler terms, there are not too many pending applicants in the philippines compare it to china and india. so aila thinks that the backlog in the philippines can be cleared around september 30, 2005 or the end of the fy 2005. now with regards to india/china if there are more than 2,800 cases that were pending...it simply means that these numbers cannot be guaranteed to have completed aos/cp, nvc processing or an interview schedule on the end of fy 2005.

there is nothing to worry about this. because aila did not said that the 50k will be gone on sept. 30, 2005. interview schedules, processing of cp/aos, nvc processing can still be done on a latter date let's say october, november and so on...aila simply states that because there are more schedule a applicants from india and china...these countries would take longer to clear the backlog rather than the phil who has only a few applicants pending.
but there would still be visas available even after september 30, 2005. for schedule a only ofcourse! so just chill out...

For your additional information...There is NO LAW on the 50K visas that it would be divided accordingly to the PIC countries. In simpler terms although this law is for the PIC retrogressed countries 50,000 VISAS WOULD NOT BE DIVIDED by THREE and then be allocated to them!
So these PIC countries would compete for the 50K...as long as your are classified under schedule A...and qualified

In simpler terms although this law is for the PIC retrogressed countries 50,000 VISAS WOULD NOT BE DIVIDED by THREE and then be allocated to them!So these PIC countries would compete for the 50K...as long as your are classified under schedule A...and qualified

But the problem is consulate in China may process cases much slower than other consulate or embassy, which means Chinese nurses may get much less visas than nurses from other countries. For instance,a nurse from China whose priority date is Dec. 2003 may not be able to get her visa while a nurse from philippine whose PD is sometime late in 2004 can start working in US with her green card in hand. Will that become true?

Jenic501,Hi! I was curious why is it your agency didn't forward your ds-230 forms to NVC?
As per procedure, once the applicant has received her packet 3, she need to fill up the ds-230 forms and other documents and send those to the NVC for processing. There is a one-year grace period on this. Visa cases that were not filed after receiving the ds-230 froms or Packet 3 will be terminated and the case closed.
If your visa fee was paid in February 2004, it is most like you received your packet 3 by April or May. It is now, June 2005 more than a year after you paid your visa fee., Please ask your agency if they have already send your ds-230 forms to NVC. Good luck and I wish you the best.

Even if your agency have not yet send your ds-230 forms but have contacted NVC either by phone or by letter that they are going to send your application at a later date then I think it is not a problem.
Just make sure that your agency has sent it already or if not they have informed NVC regarding of the situation.

That would be possible if the bottle neck is there.

hi! i'm just new here.......wanna ask, how about those with packet 3 but the papers are yet to be forwarded to and evaluated by the NVC since the agency said they were still waiting for the advice from the NVC just like my case? what are their chances to the additional 50,000 EB3 visas? my Priority Date is october 2003 and my VISA fee was already paid as of february 2004.my agency kept telling me that they are just waiting for the NVC's advice to frward my ds230 and other documents.....pls help.....thank you very much ........

Can you please answer the following questions I had for you.
1. Are you sure that your PD was October 2003?
2. Is that the time your I-140 petition was filed at at the USCIS? and if yes, did you see your Notice of Receipt or the agency only told you?
3. What service center do you belong to?
4. When did you get your Notice of Approval? and if yes, did you see your Notice of Approval Letter? Did you check your online status at the USCIS stating that your case was approved?
5. Did you personally pay for the visa fee TO THE NVC or it was your agency?
6. Did you get a confirmation from NVC (not from your agency) that visa fees were paid?
7. Do you have a CASE NUMBER that was given by NVC? (not your receipt number from USCIS) YOur case number should start at MNL followed by some characters.
8. And if you have a case number did you ever thought of calling NVC and asking about your status? You have waited for 16 months from the time you paid for your visa fee.
9. Do you know your employer or the hospital that you be working with? (Not your agency) if yes, were you able to talk to them and ask them if the job is still open?
10. Does your agency have a lawyer? Do you have access to speak with your lawyer?
11. When did you get your visa screen certificate?
My analysis on your case is this...If you said that you paid your visa fee last February 2004, which was really fast from your PD of October 2003 unless your service center is Vermont Service Center. Dates during that time were current and I think something GOT TERRIBLY WRONG ALONG THE WAY that your agency is not telling you! I mean you have waited 16 months from instructions from NVC?
Because once you have paid your visa fees and IT WAS RECEIVED BY NVC...they would automatically send you DS230 to fill it up.

hi dale ,frankly my case is at delhi embassy .so if out of 2800 cases 2000 are at chennai ,delhi should be faster ,less backlog ,faster processing good day
