update 1:
on june 6 dos ammended their june visabulletin by adding a new category for nurses (schedule - a) and making it as 'current'. that means, all wait is over for nurses now and gates are re-opened officially on june 6th.

as the regular readers of allnurses.com know, this thread can be connsidered as the continuation of the thread "worst news for rns from india, phili..." (click here to view that thread : https://allnurses.com/forums/showthread.php?t=87149). worst news thread was started when darkness and gloom hit intl. nurse community when dos announced (dec 11 2004) the retrogression for nurse immigration from these 3 countries.

appropriations bill in to a law :biggringiand henceforth , at
this very moment (may 11 2005 8:30 pm cst), additional 50,000 visas are available:melody:

DOS released their July visa bulletin indicating that visa numbers for EB3 and other workers are available. (I started a new thread here)
Dale, your "feelings" are right that they will shutdown the processing of EB3 cases, I just hope that they will make way for the schedule A visas!

It was so disappointing to know that the EB3 visa is now unavailable worldwide! Your prediction is correct, Do you think that nurses under schedule A will not be affected with this? As what you said before, they will process schedule A faster because of EB3 shutdown.
Let's all pray that everything will just turn out right for all of us.

As i have said from my earlier posts I got an unconfirmed report from a very reputable source that they will shut down EB3 to give way for the processing of Schedule A.

This is for Schedule A. This is your YEARS IN IMMIGRATION HISTORY! This is the first time that nurses DOMINATED the VISA BULLETIN.
But I think there is a problem with the statement of DOS on their July Visa Bulletin! I am analyzing it. I will post my analysis later...

in order to maximize availability of the eb-3 visa numbers for the schedule a occupations, when the regular eb-3 visa numbers are available for certain schedule a eb-3 applicants, they will take out the numbers from the regular eb-3 numbers first. accordingly, practically more numbers than 50,000 could possible be made available for the schedule a eb-3 applicants because some of the numbers, particularly filipino nurses have an earlier priority date and they will take out the numbers from the regular eb-3 quota rather than from the recaptured 50,000 pool. these schedule a applicants will take the recaptured numbers only when the regular numbers will become unavailable for them.

f. visa availability based on the "recapture" of employment-based numbers
title v, section 502 of the real id act of 2005 (division b of pub. l. 109-13 enacted may 11, 2005) provides for the recapture of 50,000 employment-based immigrant visa numbers that were unused in fiscal years 2001 through 2004. such numbers are to be made available to employment-based immigrants described in the department of labor's schedule a and their accompanying spouses and children. the immigrant classification for these 50,000 visa numbers has been designated as schedule a worker with the category symbol being "ex". beginning immediately, "ex" visa numbers may be allocated to schedule a immigrants and their dependents only; all other immigrants within the third preference will continue to use the traditional third preference classification. note that any schedule a applicant will first be eligible for a visa number under the traditional third preference cut-off date. "ex" visa numbers may be allocated to all third preference schedule a applicants from all countries, including china, india, and philippines, only if their priority date is beyond the established third preference cut-off date or if the third preference category is "unavailable". the "ex" category is current, and will remain current for the foreseeable future.
my analysis on "ex" category
the first question is: "how would you know if you are considered as "ex" category? would it be proving only that you are schedule a?
if your application is pending at nvc would you still apply in order to be considered as "ex" or would it be automatic?
would it be based on pd's as they have mentioned? as we all know people from nvc have no idea what is "schedule a" category.
how would nvc differentiate this category from the rest? and what are the guidelines attached to it?
are there any advantage to belong on this "ex" category?
for sure, we all know that all nurses are not in trouble anymore with their visas. but the problem lies with the agencies that would process them.

I just can not understand the answer of the US consulate in China that we are still in retrogress and no visa numbers are available for us! If they need sometime to process our cases, the answer should be something like go on wait for sometime. But having no idea of this change is just unbelievable that makes me really doult that nurses from China may not be able to take the advantages of this new policy! Shall I go on waiting for it? It is so frustrated! I don't even know what I am waiting for now.

When did you call them? The U.S. Embassy in Manila had published that they will start holding interview on the last week of June. There are alot of factors that may be considered by the State Department that affects the U.S. Embassy in China. It could be political or they may not yet have received the guidelines.

I contacted them after the visa bulletin was updated and there was a schedule A listed there and all three countries became current. I noticed the news on the US Embassy in Manila. It was even before the change of the bulletin. I just couldn't believe that people who work in the US consulate in China don't even know it! If it is the polictical reason, they should have simply told us that we are not allowed to go to US, thus, we won't waste so much time waiting here. We could at least consider going to someother places first. But there is still another possibility that we might be informed of the interview at any time presently which prevents us from going any other places.Things just become so strange! US govenment said they need us, the consulate won't let us go there. Are they on behalf of the same country I wonder?

All the time I was under the impression that Philippines Schedule A pending cases are larger than China/India. Looks like, I am wrong.
In my unit here in TX, we have aprox. 4:2:1 ratio (Phili:India:China).
