update 1:
on june 6 dos ammended their june visabulletin by adding a new category for nurses (schedule - a) and making it as 'current'. that means, all wait is over for nurses now and gates are re-opened officially on june 6th.

as the regular readers of allnurses.com know, this thread can be connsidered as the continuation of the thread "worst news for rns from india, phili..." (click here to view that thread : https://allnurses.com/forums/showthread.php?t=87149). worst news thread was started when darkness and gloom hit intl. nurse community when dos announced (dec 11 2004) the retrogression for nurse immigration from these 3 countries.

appropriations bill in to a law :biggringiand henceforth , at
this very moment (may 11 2005 8:30 pm cst), additional 50,000 visas are available:melody:
for nurses:nurse: and their families.

Congress has done thier job and now its up to the USCIS to act.
Lets wait and see.. June Visa Bulletinn will be out anytime now, and realistically I dont expect the PD for EB-3 SCHEDULE A will be 'current' on it. If it happens on June Bulletin itself, it will be an icing on the cake

What is the exat number of visas recaptured? I tried to search the web, I found one article as 20,000 visa recaptured for nurses, PT, and extradionary artists.
Exact 50,000
These new visas will be distributed among all Schedule A applicants. Since non-Nurses in Schedule A are very few, you can say that 50,000 for nurses!
I heard this way:
"Approximately 131,000 additional visa numbers were made available from a provision in the law that permitted the rollover of unused numbers in fiscal years 1999 and 2000 into subsequent years. Of these, 30,000 were used in fiscal year (FY) 2003. The remaining numbers are expected to be completely used in FY2005."
So 50,000-30,000 = 20,000 left for Year 2005. Is this way?

Please still be aware that family members are included with this number, so average number of visas that will actually be for an RN will probably be under 20,000..............At the time there is only a release of this amount, but a date has not been set by immigration. And the retrogression has still not been lifted.

I agree with you. Myself, for example, will be bringing my wife and three children. That means 5 US visas. Multiply that, we expect around 10,000 to 15,000 foreign nurses will get their visas this year. If we assumed all these nurses have families.
Acccording to Mr. Shusterman, http://www.shusterman.com, by October 2005, when all the visas will be used , the retrogression will set in again.
The 50,000 additional is good news to all us whose Packet 3 are with the NVC for processing. But for those who are still starting the process, this means nothing to them. 2,000 visas cap per country will not help the Philippines, India and China unless the US congress and Senate will enact a law that will instruct BCIS to use unused EB3 visas from other countries and allocate them to the PIC countries every year.
Let us celebrate because this is good news and I know many of us whose ds-230 forms were submitted to the NVC along time ago will get our Packet 4 in a few more months. :)

Could u please help me.... I am in the last stage of my consular processing. I still don't know whether i have got my packet 3 or not. I had sent DS230 in the month of october and my lawyer said that my case is in the consulate now. He had given me a number "MDR2004....". Does that mean I am in packet 3. He also said that my case is moved from the National Visa Center (NVC) to US Consulate in Chennai on November 16, 2004. Will I be able to enjoy the benfit of these 50K visas allotted? Please let me know..

To my knowledge, Packet 3 starts when you received your ds-230 forms and the visa processings start when you submitted it to NVC. Since you go to the consular method of having your visas as most of us here, NVC will send your ds-230 forms to the US embassy of your country.
Since there is a retrogression, they will not act on your packet 3 now because of the quota system and the reason that there are several others ahead of you.
But with the additional visas given, then for those of us whose papers are with NVC, then we can expect something will happen.
If by July, the visa bulletin will become current then you can expect a letter from the embassy for the interview date and PE.
Remember, these are just additional 50,000 visas for eb3 alone. But there are thousands of applicants waiting for their visas so we never know which among us will get our visas this year. But I believe for those whose priority dates fall on 2003 they have a big chance to get it this year.
The good thing with the 50,000 additional visas is that it will ease the backlog temporarily.
