update 1:

on june 6 dos ammended their june visabulletin by adding a new category for nurses (schedule - a) and making it as 'current'. that means, all wait is over for nurses now and gates are re-opened officially on june 6th.

as the regular readers of allnurses.com know, this thread can be connsidered as the continuation of the thread "worst news for rns from india, phili..." (click here to view that thread : https://allnurses.com/forums/showthread.php?t=87149). worst news thread was started when darkness and gloom hit intl. nurse community when dos announced (dec 11 2004) the retrogression for nurse immigration from these 3 countries.

There is NO state in US that does not require CGFNS Visa Screen Certificate. Moreover, states just do not have the freedom to choose it because it is a Federal (National) requirement imposed by USCIS / DHS (Department of Homeland Security). No GreenCards will be granted to any Foreign nurse without Visa Screen Certificate. Its as simple as that.

What some states DO NOT require is the CGFNS exam pass, for Ex: FL, NY, CA etc. (There is a big difference betwene CGFNS exam pass and CGFNS VIsa Screen Certificate). CGFNS exam passing is not needed to get CGFNS Visa Screen Certificate. Someone can just take NCLEX and required English exams to get CGFNS Visa Screen certificate.

Is there any chance that a Nurse will not fall into SCEDULE A???

The reason for my question is, some states does not required CGFNS visa screen. As per my knowledge CG is a sort of labour certification. So when a nurse is not CGFNS holder on what categogry she will fall into????

Is there any other chance of a Nurse beeing NON SCEDULE A?

The Visa Screen Certificate is required by all that are applying for a green card on their own. There are foreign nurses who have a green card, but not a VSC, because they are married to a green card holder, etc and hold a spousal green card. The law is that every nurse applying for a green card on their won must have a VSC.

This is completely separate from the CGFNS exam as stated above.

If you are attending nursing school in the US, you will not need the CGFNS exam. Only NCLEX. Length of time for the green card will be dependent on where your employer is located.

My friend's petition was approved last May 2004, she got her visa screen certificate last february 2004. Her case was completed last November 2004. And now asper NVC, they mailed out her documents to Manila Consulate.

Do you think they now processed according to priority date priority date? When do you think they will send my documents if my PD is August 2004?

Ahh ok sorry for that rossario. Ok i get it now, your friend was delayed because of retrogression itself that was shut down as early as OCtober 2004 as i believed. I think the majority of nurses from other forums that I have read holds a PD around 2004. So as mentioned by some here NVC people has still no idea about Schedule A being current. If guidelines would be established this month probably cases would be moving in July.

There is an "UNCONFIRMED" report from reputable sources that the Department of State is planning to SHUT DOWN the processing of the ENTIRE EB3 worldwide and even EB1 and EB2 on the final quarter to give way for the processing of Schedule A in the final quarter of the fiscal year that would start on July 1 and ends at September 30, 2005.

So brace yourselves for the adrenalin rush that is about to come! It will be a superhighway for the processing of Schedule A...

So my question is... DO YOU WANNA TAKE A RIDE?

hi! i'm just new here.......wanna ask, how about those with packet 3 but the papers are yet to be forwarded to and evaluated by the NVC since the agency said they were still waiting for the advice from the NVC just like my case? what are their chances to the additional 50,000 EB3 visas? my Priority Date is october 2003 and my VISA fee was already paid as of february 2004.my agency kept telling me that they are just waiting for the NVC's advice to frward my ds230 and other documents.....pls help.....thank you very much ........

Hi Dale! Thanks for your prompt reply. And where did you hear this news? If this will happen do you think all cases waiting for packet4 either with PD 2003 and 2004 will be included?

Hi! I was curious why is it your agency didn't forward your ds-230 forms to NVC?

As per procedure, once the applicant has received her packet 3, she need to fill up the ds-230 forms and other documents and send those to the NVC for processing. There is a one-year grace period on this. Visa cases that were not filed after receiving the ds-230 froms or Packet 3 will be terminated and the case closed.

If your visa fee was paid in February 2004, it is most like you received your packet 3 by April or May. It is now, June 2005 more than a year after you paid your visa fee., Please ask your agency if they have already send your ds-230 forms to NVC. Good luck and I wish you the best.

Though DOS has ammended June 2005 Visa bulletin (VB) to add another category for Schedule A, as we've read from other posts, its not really in to 'effect' now. Service Center/Consular officers outside US were not aware of this change or have not recieved ammended version of June Visa Bulletin.

It was no surprising for me, because the immigration officers need to have the official version of the bulletin and detailed instruction (thru an internal memo) on how to effectively 'apply' the change. I think that could be the reason, DOS was little reluctant to ammend the June 2005 bulletin, becuause they might have guessed that it is not going to do much benefit but would initiate lot of enquiries by the despeartely waiting nurse immigration commnunity.

I hopefully assume, along with July 2005 Visa Bulletin, DOS will send detailed instructions to Service centers and Consular offices on 'how' to apply this new category on VB, effectively for the faster processing of Nurse GC's.

Though it is not of much importance for us, other Non-Schedule A EB3 category folks are anxiously waiitng for the July VB as well. This is because they frankly think their (Non- Schedule A) PDs will move sginificantly, since a new queue has been formed for Schedule A by removing nurses/Pts from their lengthy queue.

NYRN is right, many E3 cases whose not schedule A are anxiously waiting for the July vise bulletin. Many are saying that the July VB may go either way, there's a lot of speculations but I hope it will move forward for their sake and ours too if you think about it. Movements may mean that DOS and NVC knows already how to go about the new schedule A processing and process quickly.

Am crossing my fingers for everyone!

06/12/2005: 50,000 recaptured visa number for schedule a and state department policy

  • according to aila, 50,000 recaptured visa numbers may most likely cover most of the philippines schedule a eb-3 demand, but they are uncertain whether it will also cover all the pending chinese and indian eb schedule a applicants for the rest of fy 2005. there are currently known to be approximately 2,800 china/india eb-3 schedule a applicants pending.
  • state department also reportedly predicted that most of these 50,000 would be depleted by the nurses rathern than other schedule a occupations.
  • couple of positive news for the schedule a eb-3 applicants:
    • as we reported earlier, the state department amended the visa bulletin for june 2005 making schedule a eb-3 current. the numbers are are now available.
    • in order to maximize availability of the eb-3 visa numbers available for the schedule a occupations, when the regular eb-3 visa numbers are available for certain schedule a eb-3 applicants, they will take out the numbers from the regular eb-3 numbers first. accordingly, practically more numbers than 50,000 could possible be made available for the schedule a eb-3 applicants because some of the numbers, particularly filipino nurses have an earlier priority date and they will take out the numbers from the regular eb-3 quota rather than from the recaptured 50,000 pool. these schedule a applicants will take the recaptured numbers only when the regular numbers will become unavailable for them.
