update 1:

on june 6 dos ammended their june visabulletin by adding a new category for nurses (schedule - a) and making it as 'current'. that means, all wait is over for nurses now and gates are re-opened officially on june 6th.

(click here to view that thread : https://allnurses.com/forums/showthread.php?t=87149). worst news thread was started when darkness and gloom hit intl. nurse community when dos announced (dec 11 2004) the retrogression for nurse immigration from these 3 countries.

Can I just say I find it very difficult to read and understand your posts. I do not want to offend you but I am getting to the stage that I just bypass them because it takes me too long to read. I am sure you are writing very relevent interesting posts and I am wondering if occassionally you could write in sentences which I can understand thank you :)

I am English born and bred and it is my first language so if I am having difficulty then some of the other guys who's first language is not English may be having more problems than I am.

the nurses here in india are hungry for news that can help them through this period of crisis ,many of them are from medium to poor socioeconomic backgroud,it would be highly appreciated if we could get on with news instaead of splitting hairs,when i said english i did not mean british,(see no capitals but no new news or views either)thats what you want (note you not u ) god bless and goodbye

can I just say that I also don't understand your posts but I think it has more to do with // between every sentence. Also writing in captitals is classed as shouting and also hard to read. Another thing it has nothing to do with coming from a foriegn country

i do not believe the statement of shusterman that the department of state is consuming 30,000 visas per month because of adjsutment of status made by uscis because that would be against the law. the immigration and nationality act states that not more than 27% of the worldwide limit of employment based visas (140,000) can be used for the first three quarters of any given fiscal year. since we are still on the month of may and approaching june we are only on the third quarter of the u.s. fiscal year. (the u.s. fiscal year would start at october 1 and ends at september 30.) they are only allowed to use 37,800 per quarter or 12,600 per month. if you do not believe me please download and read the immigration and nationality act sections 201, 202 and 203.

one more thing, if there are thousands upon thousands of green cards that were being distributed by dos...why? why? why? on earth no one on other forums are celebrating because they have their greencards arrproved. please check other forums...there are forums are murthy.com, immigration.com, etc.

all remaining visas can only be used at the last quarter of the u.s. fiscal year which would start at july 1, 2005 and ends at sept. 30, 2005. there would be approximately 26,600 eb visas the remaining would be 19% of 140,000 (27%times 3=81%...100%-81%=19%of 140,000)plus 7,000 unused family based visa numbers, and the ac21 visa numbers 101,000. in the last quarter of the u.s. fiscal year there would be more than 134,600 employment based visas for all categories if we follow the law. take note...these remaining visas can be used for all eb categories. the 50k visas for nurses is a different thing.

logic is not only the key in predicting visa numbers. mastery of mathematics, statistics, visa history and the u.s. immigration law is the key.

assuming that i am wrong and atty. shusterman is right that uscis in fact are using 30,000 visas per month through adjustment of status and dos are giving out these visas even it is a clear violation of the ina (i hope you have read the ina)

please try to analyze first...why is there a huge demand in adjustment of status? you should have knowledge on what happened before. there was a bill that was signed into law called the american competitiveness in the twenty first century act of 2000 or ac21. (please also read and study what this law is all about) but i will explain the ac21 on simpler terms.

the ac21 law did two important things on immigration history. first it recaptured unused empoyment based visa numbers (130,000 eb visas) from years 1999 and 2000. second it increased the allotments of non-immigrant visas from 65,000 (from years 2002,2003) to 195,000 from year 2000 up to 2003. this gave it engineers, computer wizards, accountants, consultants, teachers, managers and ceo, healthcare workers, etc to enter u.s. on working visas. hundred thousands of them enter the u.s. on working visas.

now this is logic...if someone is on working visa all of them would adjust status to lawful permanent resident or apply for green card. so this is where the demand takes place. last year (2004) many have become legitimate to adust status that is why right now there is a huge demand for visa numbers.

last year also...the uscis notified the us congress that they have intentions to clear the backlog of cases that are pending (why did the uscis notify congress? simple...because the uscis ask for a huge amount of money in the congress for their budget to eliminate the backlog)

and so it was done. last january 1, 2005 retrogression took place because of the adjustment of status by uscis...i hope all of you know what is retrogression:rolleyes:

ok this is the conclusion...assuming shusterman is right that there are 30,000 cases per month that were being approved by uscis...the 50,000 visas has nothing to do with it because it is reserved for nurses and pt's. those people who were adjusting status came from all sorts and all kinds of employment based categories.

one potential delay is that the national visa center (nvc) appears to have reallocated resources in light of the retrogression. it may take some time for the nvc to reach pre-retrogression efficiency. "

what does hammond law mean when the dos has reallocated resources in the light of retrogression? my analysis is this...when dos estimated and predicted that there would be a retrogression (and most of the work will be done by uscis because many cases are aos) dos has reallocated its resources (personnel). now with this new law that was passed for nurses and the backlog reduciton efforts of the uscis...plus the visa numbers that would be available for use in the last qaurter...

the dos has estimated that they cannot process all at the same time because they have no resources or lack the personnel to do so. so what they would do since these schedule a are also first priority (because the need for health care is huge... with all the pressure from aila, american hospitals, health care institutions)...

they have announced that the eb3 category would be unavailable worldwide. they have to shut down processing of eb3 to give way for schedule a.

the safest estimate would be all schedule a whose pd are below dec. 31, 2004 will surely have a share of the cake. the wildest estimate well it would last for three years.

i hope all of you understood my "simple" explanation...and please don't ever brag about your exam scores on exams that you had...i am sure nobody is perfect.

your post is well researched. i do enjoy reading all your posts very much. it is very helpful and i am sure many will agree. i personally rely for informations about retrogression from your posts since i donot have much time to study and understand the laws made about it. keep it up! and i am with you too in telling everyone here that we should not brag about our score exams. instead of being subjective about each other, let us help one another in providing sound information and opinion regarding retrogression and how it affects our possibilities of working in us.
