AOS and EAD

Can anyone tell me when to expect to get EAD once you file AOS. I already have visascreen.

I-140 was approved on 12/12/06. Just done with classroom orientation.

yap he is working illegally. I dont know why he is being deported. I think his tourist visa expired last year and he extended for another few months and again his extension already expired too..thank you silverdragon :)

There are many reason to be denied. Everything depends on the case: type of visa, documents etc. For AOS, visa screen is an important document as all others like US license, and proof of being legal in the country at the time of AOS submition. After deportation he must wait for 2 years before filing again (to my best judgement).

No one is supposed to work illegally (under the table), but i doubt that INS is able to keep track on it. So I dont think that was the case.

if he is deported why is it that he will able to choose when to come back here in PI? I thought if you are for deportation u cant choose what date you want if you go home. But his attorney already filed for his 2nd AOS last september but still pending..thank you for your reply :)

What was the reason given to him on why the AOS was denied ??

Working 'under the table' and going out of status after his tourist visa and extension has expired already are grounds already for being 'deported' and if these were the reasons then there is a 3-10 year ban for him.

Another reason is if it has been found out that he has gravely 'mis-used' his tourist visa.

The some of the things I can think of but the official reason given to him on why his AOS was denied would be be better.

He didnt want to talked about it when we are chatting coz he think that officer may find or track him through computer..LOLZ..he's going to tell me all that was happened to him when he come back here next month. I think he's deported because of mis-used of visa. Why his attorney filed for his 2nd AOS if he's deported? Or is it alright if he do consular processing here in philippines?

Not sure if he can return to the US right away though because depending on the official reason given to him - there will be a 3 to 10 year ban that will be imposed once he's back home.

It's better that your friend seek a reputable and honest immigration lawyer.

But one thing is for sure is if he is indeed being 'deported' for 'mis-use' of his tourist visa then there will be at least a 3 year ban on him if he goes back.

Actually, everything I just said is generally 'mis-use' of tourist visa.

If you can get the EAD, it will not be revoked, and you can continue to work with it. Unless, you become in violation of one of the rules for it.

How long can we work with EAD, I mean did EAD have period of validity?

:santa5: ead has an expiration of 1 year, you need to renew it 90 days before it expires, but if you receive your green card before the expiration date, no need to renew. i hope this helps...
