pls help me on this one, i took my 3x first was nov of 2011 my test was cancelled bcoz i used my phone so then they send me a letter to appeal, after sending them my appeal they did not approve it, it says i can re appeal again and they will check it every 2 months or just plea guilty, i didnt want to wait that long so i plead guilty and after couple of weeks i recieved re examination. So the 2nd one i failed recieved a bad pop up so they send me another rexamination i took my test july 21,2012 and got the good pop up for 2months of waiting. And i got a letter today saying denial of application for licensure because of what happen on nov 21,2011. I can request for hearing within 60 days after 60 days my right for hearing will be deemed waived and request to wait one year before reapplying for licensure. I don't get it,before they send me a re examination wouldn't they review my records and application? it's killing me guys i hope you guys can give me an advice thanks!

You are posting this to someone who hasn't been on this site in three years. I wouldn't hold my breath waiting for a response!

I doubt it because they haven't been here in 3 years, you were dismissed from your exam, they were denied licensee subsequent to a third NCLEX attempt. The same thing didn't "happen" to you, you both made a choice to not follow the rules that you read before entering the exam room, and signed & attested that you agreed to abide by, therefore you both made the same choice to test whether the rules apply to you.

If you do it may be with sanctions by the BoN. How can you pass if you did not finish?

I was asked to leave after the incident in the bathroom and not permitted to return to finish the exam in the room. I was on 179 questions. I guess they grade me on what I have done

No. The NCLEX is designed to shut off once a candidate has reached a 95% Confidence Interval. This means that it does not stop until you have either demonstrated to a 95% certainty that you are competent to begin practice, or incompetent to begin practice. There are exceptions but you DO NOT MEET those criteria. Your test, if unfinished, had not actually concluded as it should.

If you were prevented from finishing the exam, and it hadn't stopped on its own yet, you did NOT meet the CI to pass.

I'm wondering if your exam WAS DONE at 179 questions (whether or not you noticed it was done?) and when you were told you would be reported to the BoN for infractions against the rules of the testing site the test was finished anyway. You might have gotten back to the computer only to find that after you cleared the 'break' screen it was done.

IF THAT is what happened, and you WERE DONE.....whether or not you passed has nothing to do with whether or not you will get a license. If the Board of Nursing determines that your actions during the exam disqualified your test result, they can invalidate it. Make you test again. Or refuse to allow you to test again. Or decide it was no big deal and give you the license.

Any outcome at this point is entirely out of your control. You might have passed the exam IF you finished....you did not pass if you did not finish, it's just that simple. You are not scored based on how far you got when they kicked you out of the testing center. Not how it works.
