pls help me on this one, i took my 3x first was nov of 2011 my test was cancelled bcoz i used my phone so then they send me a letter to appeal, after sending them my appeal they did not approve it, it says i can re appeal again and they will check it every 2 months or just plea guilty, i didnt want to wait that long so i plead guilty and after couple of weeks i recieved re examination. So the 2nd one i failed recieved a bad pop up so they send me another rexamination i took my test july 21,2012 and got the good pop up for 2months of waiting. And i got a letter today saying denial of application for licensure because of what happen on nov 21,2011. I can request for hearing within 60 days after 60 days my right for hearing will be deemed waived and request to wait one year before reapplying for licensure. I don't get it,before they send me a re examination wouldn't they review my records and application? it's killing me guys i hope you guys can give me an advice thanks!

I'm so sorry to hear about this. It must be very stressful for you. I'm no expert with nursing laws so I cannot give a specific advice. But if I were in your situation, I would read as much as I can about nursing law and jurisprudence in your state. It's different in every state. You need to understand the law so you can defend yourself better, and you don't get screwed over. Be very careful in making decisions. Don't make drastic decisions that could potentially affect your case. Also, I think it would be very beneficial if you seek the advice of a lawyer. I hope you will be able to resolve this soon. Thanks for the response, im just so confuse, i took the test twice and went tru the process twice with no problem. I appreciate your reply.

I would appear before the hearing and give them your side of the story again. I think if the deciding people sees a human being trying to defend themselves for what seem to be an honest mistake, but know that using a cell phone was always a no-no rule and you should have not picked up the cell phone.

However if you made the call, then yes, I can see them taking back their decision, even after they gave you another chance and you passed.

I don't think you need to hire an lawyer, unless you can find one that offers free advice for the first 1/2 hour or so, just present yourself to the hearing people and say you understand what you did was wrong and wasn't meant to look like you were cheating (trying to get an answer to a question).

But also, recognize that by talking to anyone on a cell is very disruptive to those around you and you may have caused others around you to lose their concentration and you may have caused them to not pass due to the forbidden rule and honestly, a very irresponsible call on your part.

I live in california. i will follow your advice, the (DCA) told me to fax a letter saying what happen about the issue of using my cellphone , and i told them that ive already sent my appeal at NCSBN and asked if they got a copy and they told me no. After 2 days i got this letter. So your suggestion is state what happen again? and what else do i put on that letter, like i dont know how to ask them if they can forgive me? thank you for your reply.

You need a sound LEGAL advice. As you've mentioned, you did plead guilty earlier.

By doing so, you placed yourself in a different ballgame.

You can always earn back the money you pay for (lawyer) prof fees, but once

they decide adversely on you case, who knows if you'll ever get a shot at

getting an RN license?

I completely agree with this statement. I grew up around lawyers, so I know a little about things like this. He's right, pleading guilty puts your case in different ballgame. Hence I mentioned in my last statement to be very careful in making decisions that can potentially affect your case. Remember that everything you do relating to this case changes the tides, either positively or negatively. I'm sorry to tell you this, but the law and the people enforcing them (BON for this matter) aren't very forgiving. I'm not sure if not talking on a cellphone during NCLEX is actually a law, but I know it's a very important RULE that everyone needs to follow, and I think BON takes that very seriously. You need to be assertive. You can't just rely on BON's mercy. Your whole career is at stake. You need to read and learn as much as you can about the law, and about your case. And yes, a sound LEGAL advice would be very beneficial.

Your frustration is palpable, and I do not want to add to it.

First, you need to SLOW DOWN. Think before you act! Think before you type! This site has clear recommendation of no text speak. It makes your post difficult to read. Take time to gather your thoughts. You will get better advice. Compose yourself, take a deep breath, and proceed w care and caution.

Next, you have to follow the rules. I cannot imagine using a cell phone during a career make-or-break exam. If the issue was emergent, you should have gotten up and spoken w Proctor BEFORE taking the call.

Were you just not thinking? Why did you do that? I am sure the Board is or has asked you that question.

When you deal with the Board, you have got to appear pulled together.

My whole point here is that, they told me that they are not accepting my appeal at all so if i plead guilty they can start the whole process of making a decision wether to suspend me for 1 year , ban from bon, or retake the exam ETC,it even says that "PLEASE ADVISED IN THE FUTURE TO APPLY TO NCLEX EXAMINATION OR IN DIFFERENT BOARD OF NURSING THE BOARD WILL BE NOTIFIED THAT I HAVE A VIOLATION AND THE BOARD WILL BE NOITFY TO AUTHORIZE YOU TO TEST, so few weeks later i got the application for licensure which we call reexamination application so i assume that their decision was to let me retake it and after paying 150 for processing fee which they would check your record, i got the aTT which it says i am eligible to take the nclex, and like i said i failed the test and was able to retake it again, but the result says DENIAL OF APPLICATION FOR LICENSURE which i took it twice... Thanks for listening guys i really appreciate it. By the way rose i went on break then used the phone.
