you can consider this thread as closed since information posted here became obsolete on may 11 2005, once president george w bush signed the apropriations bill in to a law to make additional 50,000 visas available for nurses. this thread was started on dec 11 2004 when the worst news hit rn community that the pd dates have been retrogressed to jan 2002 and nurses will be the hardest hit.

now its official.

pd dates for eb3 cases from india,china, philippines retrogress to jan 2002.

this is worst news for the rn community who wish to migrate to us.

this means that, rns who are already in us will not be able to file i485 (aos) after dec 31 2004 till the priority dates become current. its not clear how long it will take.

those who have managed to file aos will have a huuuuuuuuuge waiting time for their gc apporval.

those who are outside us, will have a loooooooong wait

for someone who is in us and has either cgfns/ncelx (with or without visascreen), the only option is to get an employer to file for i140 and 485 before dec 31 2004. this will make them eligible for ead and legal status in us.

considering the rn shortage, there are chances that they may introduce a new visa category or an exception for nurses. depends on how hard the empoyers lobby the congress.

i say june 2005 others say six months i wonder six months fromwhen does it mean 6 months fromnow i.e. oct 2005

its allfalling intoplace i.e.why lantos billis moving sluggish it is because they have a better option of must pass appropriations bill pending in congress session 109th ,the whole establishment is mobilized for these bills

the appropriations bill covers others(OTHER THAN NURSES ) also as it extension of AC -21 which already has wide acceptance all over the country whereas the lantos bill only pertains nurses therfore the appeal is thus narrower and also it has to undergo more scrutiny

Mr Tom Lantos submitted a bill in the senate (HR 139) to recapture the unused visas for hiring overseas nurses.The bill will pass within 45 days.Its good news for all overseas nurses who are in the pipeline.It is confirmed that 90% bill get pass in the house.ANd American Hospital Association also wrote a letter to House of Representative about the impact of nurses shortage.

So it is a good news that temporarily retrogression will stop.

But the retrogression may come back again after one year.

At this movement lets hope for the best.

For someone who is in US and has either CGFNS/NCELX (with or without Visascreen), the ONLY option is to get an employer to file for I140 and 485 before Dec 31 2004. This will make them eligible for EAD and legal status in US.

Sorry to dissapoint you guys but Tom Lantos bill was filled Jan 2005, but now it's already april nothing was heard about it but hoping that it (lanto 's bill) will be incorporated as amendment to another bill

this week the senate is taking up appropriations bill (must pass)and ammendement of AC21 is part of that LINK (SISKIND IMMIGRATION BULLETIN FOR APRIL)ALSO SHUSTERMAN BULLETIN BY 21 APRIL THE BILL WILL PASS THE SENATER AND THEN GO TO HOUSE SENATE COMMITTEE BY 30 APRIL

I wouldn't quit your job in anticipation of this.................thwere has been talk for some time and Congree just doesn't work like that and get things done quickly, in a normal fashion. There are many other things tied into this, such as tech jobs going to these countries, etc. Just proegress with getting all of your documents in hand, which means a Visa Screen Certificate, etc... and getting NCLEX done............

Even for nurses from the UK that went with an agency, it has taken them two yearson average and they are not under any retrogression.
