you can consider this thread as closed since information posted here became obsolete on may 11 2005, once president george w bush signed the apropriations bill in to a law to make additional 50,000 visas available for nurses. this thread was started on dec 11 2004 when the worst news hit rn community that the pd dates have been retrogressed to jan 2002 and nurses will be the hardest hit.

now its official.

pd dates for eb3 cases from india,china, philippines retrogress to jan 2002.

this is worst news for the rn community who wish to migrate to us.

this means that, rns who are already in us will not be able to file i485 (aos) after dec 31 2004 till the priority dates become current. its not clear how long it will take.

those who have managed to file aos will have a huuuuuuuuuge waiting time for their gc apporval.

those who are outside us, will have a loooooooong wait

for someone who is in us and has either cgfns/ncelx (with or without visascreen), the only option is to get an employer to file for i140 and 485 before dec 31 2004. this will make them eligible for ead and legal status in us.

considering the rn shortage, there are chances that they may introduce a new visa category or an exception for nurses. depends on how hard the empoyers lobby the congress.

Hi suzanne, I am new in the site and confused. Maybe you could clear up some information I am recieving lately regarding retrogression. I am license CA nurse from the Philippines. I am still waiting for my visa screen certificate here in the Philippines. I have tourist visa and social security number (i used to work before in CA not as a nurse). If I come to USA as tourist could I possibly make adjustment of my status once I got my employer. Its true that I can't file I-485 and EAD at the same time? Also are nurses qualified for EB2 visa if they have advanced degree and have more than 5 years of professional expericed? thanks zuriel.

This lawyer is the only one that is poisting anything at the moment about this. Even if things open tomorrow, there is still enough of a backlog to hold things up at the Embassy level in Manila. I expect that things won't straighten out before July, as I said before. There are still many, many in the same boat as you.............so a wait exists just the same. Also, which state are you going to be working in? That plays a big difference also.

This is beneficial to nurses already in the US on a different type of visa who wish to file for a Change in Status, but times are still going to be drawn out for those of you out of the country. Remember that Embassy appts are made on an individual basis, and there is quite a bit of time involvement there. The UK alone has about a 4 month wait on average.

So, if you have a current job in your homeland, don't quit it yet.

You need to find out if they were accepted, just because they were filed, that doesn't mean anything. If you have been reading this post, there has been a retrogrssion in effect since January 1, or even a little before. I recommend that you speak to your attorney............

You need the government acting on your application..............and they have just started back in the last week on ones that they already had in hand before the end of the year. New ones, which yours would be one, are still under the retrogression................

Oh... But I am not from those three countries though... I am from Taiwan, and as I know the retrogression shouldn't have any affect on me... My lawyer told me I should be able to get my EAD within three months...

shusterman april update says that the senate will be shortly voting on visa recapture /ammendement to/ac 21//and it willlikely gotosenate house by end of month //lets hope something comes out of this

The insiders in the immigration circles had called it right once again!

As per the latest VisaBulletin published today, the EB3 Cases PD is moved to June 1 2002. So, all together, it took 4 months to move 5 months ahead..

As I have stated all along, it will be at least six months before you see any significant changes. The US Government just doesn't act that quick in things like this, plus there is much more at stake than just nurses. Others are also covered under this same EB3.
