you can consider this thread as closed since information posted here became obsolete on may 11 2005, once president george w bush signed the apropriations bill in to a law to make additional 50,000 visas available for nurses. this thread was started on dec 11 2004 when the worst news hit rn community that the pd dates have been retrogressed to jan 2002 and nurses will be the hardest hit.

now its official.

pd dates for eb3 cases from india,china, philippines retrogress to jan 2002.

this is worst news for the rn community who wish to migrate to us.

this means that, rns who are already in us will not be able to file i485 (aos) after dec 31 2004 till the priority dates become current. its not clear how long it will take.

those who have managed to file aos will have a huuuuuuuuuge waiting time for their gc apporval.

those who are outside us, will have a loooooooong wait

for someone who is in us and has either cgfns/ncelx (with or without visascreen), the only option is to get an employer to file for i140 and 485 before dec 31 2004. this will make them eligible for ead and legal status in us.

considering the rn shortage, there are chances that they may introduce a new visa category or an exception for nurses. depends on how hard the empoyers lobby the congress.

And i'm applying for OPT,but i really don't know which hospitals will sponsor me for Green Card. May be somebody knows hospitals in NY? Do i need to pass NCLEX first?

Before you worry about who will sponsor you, you need to decide where you wish to work....what type of area, teaching hospital or not?, NYC or not, etc... Do not pick a facility because they will sponsor you, pick someplace first that you really wish to work at.

You must apply for the OPT before you graduate from school, it can not be done later. so having NCLEX by then is out of the question. You need to be finished with school before you can sit for the NCLEX.

I definitly want to work in NYC,big teaching hospital, cardiac unit.

I have an expirience 4 years as LPN in Israel in post op thoratic and cardiovascular surgery department.

How do you think ,it's better to find agency or to find hopsital by myself?

Are you interested in any of the facilities where you have done any of your training?

In your case, since you trained in the US, you should be able to find a hospital on your own. That is the best way..........

Since i did my training in hospitals that far from the City -Lon Island, i don't know hospitals in the City, but i'll figure it out when i'll go to OPT. Should i ask that I 'am interested in Green Card at the time of interview for OPT?

The priority date for EB3 skilled / professional workers from mainland China, India, and the Philippines moved ahead to April 1, 2002. This means that those charged to those countries in the EB3 skilled / professional worker category, who are the beneficiaries of labor certifications or labor certification-exempt I-140 petitions filed before April 1, 2002, are eligible to file the I-485 application to adjust status or pursue consular processing during the month of April 2005. Additionally, persons in this category with priority dates that are now current, who have already filed the I-485 but found their cases "on hold" due to retrogression, now once again are eligible for case approval. All countries other than India, mainland China, and the Philippines remain "current" for the EB3 skilled / professional worker category. This means that there are sufficient visa numbers available for all priority dates for those nationals at this time.

hi everyone! i am new here and i am glad to hear all the informations you've provided. as you can see guys comparing to all of you i am way, way behind in terms of applications and just about everything. well, keep us all updated at least there is still a glimmer of hope for nurses like me aspiring to work in US.

Ia am not sure who murthy.com is but there is nothing posted in the State Dept. updates about this. And until I actually see the US Government publish something to this effect, I will err on the side of the govt here. Who is murthy.com?

This lawyer is the only one that is poisting anything at the moment about this. Even if things open tomorrow, there is still enough of a backlog to hold things up at the Embassy level in Manila. I expect that things won't straighten out before July, as I said before. There are still many, many in the same boat as you.............so a wait exists just the same. Also, which state are you going to be working in? That plays a big difference also.

This is beneficial to nurses already in the US on a different type of visa who wish to file for a Change in Status, but times are still going to be drawn out for those of you out of the country. Remember that Embassy appts are made on an individual basis, and there is quite a bit of time involvement there. The UK alone has about a 4 month wait on average.

So, if you have a current job in your homeland, don't quit it yet.

As I said above, do not quit your day job based on this. The immigration offices have a pile of things do get thru, including documents that have been sitting there, as well as the US Embassies have quite a backlog right now.
