Rep. Jamie Raskin Lead Impeachment Mgr.sent written invite to Trump to testify in person, with a 5p Friday deadline for Trump to respond .  Lead defense lawyer Bruce Castor reported response: "No".

"Whereas a sitting President might raise concerns abt distraction from their official duties, that concern is obviously inapplicable here. We therefore anticipate your availability to testify."

Dude, in my tiny little world I have to be extremely careful because I am a very large person(despite my pretty face ???) just kidding, about my voice's volume, tone, about my space because I loom over people, essentially self awareness, to prevent my content from being taken out of context or intimidating people. I don't even use my wit, because it becomes intimidating instead of funny, again because of my size. 

Now consider the bullhorn that Trump or his acolytes have, what sort of messages and how much should they consider before they vocalize their thoughts? Actions have consequences! And, we need to consider the impact of those actions! 

For example, I know if we met in person we would get along well because you stand up for your beliefs and I respect that. Civilized people conduct themselves in a civilized fashion. IMO, they are not considerate or civilized nor do they consider the impact of their communications except to their own constituents.

That's a really good ploy from the Dems. They could get him into serious trouble if he complies. Seriously, good move from the Dems.

The former chief of the US Capitol Police provided Congress the clearest timeline yet of the events leading up to and including the January 6 insurrection, casting blame on four federal agencies and a slow bureaucracy that harmed the department's ability to secure the building that day.

"Contrary to what others have said, the USCP did not fail. There are many heroic stories of USCP officers that day that helped to ensure the safety of the Members of Congress, including two officers who lost their lives," Steven Sund wrote in a letter to House Speaker Nancy Pelosi and the ranking members of each party in the House and Senate. "Democracy prevailed on January 6, 2021, in large part because of the courageous actions of the United States Capitol Police."...

...Sund wrote that he made his first request for the National Guard at 1:09 p.m. ET and the request for local police agency support at 1:51 p.m. It took more than three hours to get National Guard support approved, Sund wrote.

"I still cannot fathom why in the midst of an armed insurrection, which was broadcast worldwide on television, it took the Department of Defense over three hours to approve an urgent request for National Guard support," he wrote.

After the guard was approved, it took time to get the first members sworn in at the Capitol. The first guardsmen weren't sworn in at the Capitol for more than four hours after the initial request, around 5:40 p.m.

March from the Ellipse to the Capital as captured by cell phone data helps show that the rally speakers direction to "March to the Capital" came from rally attendees.

The Constitution Doesn’t Bar Trump’s Impeachment Trial

...The strongest argument against the Senate’s authority to try a former officer relies on Article I, Section 4 of the Constitution, which provides: “The president, vice president and all civil officers of the United States, shall be removed from office on impeachment for, and conviction of, treason, bribery, or other high crimes and misdemeanors.” The trial’s opponents argue that because this provision requires removal, and because only incumbent officers can be removed, it follows that only incumbent officers can be impeached and tried.

But the provision cuts against their interpretation. It simply establishes what is known in criminal law as a “mandatory minimum” punishment: If an incumbent officeholder is convicted by a two-thirds vote of the Senate, he is removed from office as a matter of law.

If removal were the only punishment that could be imposed, the argument against trying former officers would be compelling. But it isn’t. Article I, Section 3 authorizes the Senate to impose an optional punishment on conviction: “disqualification to hold and enjoy any office of honor, trust, or profit under the United States...

Thus a vote by the Senate to disqualify can be taken only after the officer has been removed and is by definition a former officer. Given that the Constitution permits the Senate to impose the penalty of permanent disqualification only on former officeholders, it defies logic to suggest that the Senate is prohibited from trying and convicting former officeholders.

Some have argued in the alternative that the trial is unconstitutional because Chief Justice John Roberts won’t be presiding. (Majority Leader Chuck Schumer said the chief justice was asked and declined.) Article I, Section 3 provides that “when the president of the United States is tried, the chief justice shall preside.”

This argument is mistaken, and the definite article is why: Mr. Trump is no longer the president. Section 3 excludes the vice president from a trial of a sitting president because she would accede to the office if he were convicted. No such consideration applies to Kamala Harris. It appears that Ms. Harris has also declined to preside, so the role will be filled by President Pro Tem Patrick Leahy. But she could unilaterally reclaim that prerogative at any time, including to cast tie-breaking votes on procedural motions or the decision to disqualify Mr. Trump....

What we know about how Trump's second impeachment trial will go

The trial starts Tuesday 1PM EST. 

  • The Senate impeachment trial will be aired on most major TV news networks. If you don't have cable, here's where you can view the trial for free.
    • C-Span (website)

    • CNN
    • PBS News Hour
  • There will be up to four hours of debate and then a vote on the constitutionality of an impeachment trial for a president who has already left office.
  • Up to four eight-hour days of arguments. 
    • The House managers and Trump's defense team are each allotted up to 16 hours spread over two days to present their cases.
  • Up to four hours of Q&A by Senators
  • Different presiding officer. Chief Justice John Roberts, declined to preside since Trump not sitting president. VP Harris declined.  Sen. Patrick Leahy, Senates President Pro Tempore , who presides over the chamber in the absence of the vice president (a constitutional role given to the longest serving senator of the majority party) will preside following Chief Justices prior Impeachment script.
  • Debate on witnesses  After the Q&A, the two legal teams will debate the need to subpoena witnesses and documents.
  • Up to four hours of closing arguments and an unspecified amount of time for senators to deliberate. Then a vote on the article of impeachment. Conviction requires two-thirds of senators present to offer "guilty" votes =  67 senators, which would require 17 Republican votes.

That seems telling, that he "declined" to preside. 

And, Leahy is going to preside, and vote?

What a sham.  It will be fun to once again see the air go out of the Dems get Trump balloon.   It would he amusing if it wasnt such a waste of time and money when there are so much more pressing issues  to be dealt with that are not.  Like the last time.

I wonder what's being done to deal with the thousands of migrants again gathering at the border,  and now are being let in.  Without being tested for Covid, btw.

You think that there's something more pressing than dealing with someone who tried to overthrow the American govt, aided and abetted by how many republican officials and in how many different states? 

Currently the GOP in Arizona are trying to jail in Maricopa County the board that certified the votes. Happened today. In Michigan the GOP have replaced the person who didn't side with them when they tried to throw the election. 

Biden has managed in a few weeks to do more than Trump has done in his four years. Can you imagine the turmoil of this country if he had won or manage to overthrow the election? 

He needs to be impeached and prevented from running again and a lesson sent to the republican party to stop their criminalistic behaviors! 

All of those officials in Arizona and Michigan should be charged by their constituents for not dealing with their county's business and wasting tax payers money. 

They need to have a clear and precise message sent re malfeasance will be prosecuted! It should apply equally to the few Democrats who also engage in criminal behaviors!
