Hot off CNN:  Trump defense Team left as he wanted them to say "Fraudulent Election" defense. Doesn't look good when Butch Bowers, an experienced political attorney who has represented numerous Republican elected officials who feels "everyone deserves a defense" quits as Counsel. That brief is stunning in it's contradictory and sophomoric stances. 

They go on and on about how the Senate trial is unconstitutional because the embezzling banker no longer works at the bank...and then they complain later that the absence of the chief justice at the trial is an affront because the banker deserves credit for being a banker. 

Holy hell.

Graham is warning Democrats against calling any witnesses when the Senate impeachment trial of former president Trump kicks off next week.

This, of course, is consistent with the Senate Republican strategy, which is to oppose impeachment on constitutional grounds (the technical legal argument that the Senate lacks jurisdiction to conduct a trial of a non-incumbent official)...

The Constitutionality of Trying a Former President Impeached While In Office

...I interpret the Constitution to mean that a president who actively sought to overturn the results of a free and fair election to maintain himself in office as an unelected autocrat—and who has publicly proclaimed an intention to return to the presidency—can, having been impeached while in office by the House, be thereafter tried, convicted and disqualified from future office by the Senate. Professor Bobbitt says the Constitution prohibits the completion of this exercise in republican self-protection because the president sought to overthrow democracy late in his term and the Senate didn’t start his trial fast enough to allow both removal and disqualification. I think that Lindsay needs to be very careful because once Garland is confirmed and the justice Dept gets going with those RICO investigations, everybody is in jeopardy! 

With RICO there's no claiming or faking especially for Trump etc. It was designed to catch those mafia bosses who Trump likes to emulate, re saying things but claiming that they didn't order anyone to do anything. 

I think that is something Trump never considered re RICO being applied to him. It opens up investigations in a whole different way! 

This could ensnare everyone involved in every scheme IMO. I especially want to see Stephen Miller and Mnuchin go down.
