retrogression in this october again???

i just saw the good news in july's visa bulletin. Congradulations to all of us!! I have a question to ask here. According to the hospital immigtration attorney, my petition I140 will file in early July. However, some people here said, the retrogression will come back in October. I have started worrying about my case already. I140 normally takes 3 months to approve. But if retrogression comes back at that time, I wonder what will happen to my case? Any comments??:uhoh3:

hello suzanne,been wondering about my case. I have a PD which is current this month. My agency told me that NVC requested me to submit an updated DS 230. I have my documents resubmitted in NVC last october 2006, so I did submit it. Why they are asking for it? would I have the chance of receiving packet 4? thanks for the reply...you're such a good help.

Hi! What's your PD?.... a lot of us here who are stuck in packet 3 and have submitted all the docs before the retrogression took effect are now being asked for another ds230. Seems we have to update our docs:uhoh3:

Yes, were definitely the same.... though I'm still waiting for the "go-signal" from my lawyer to resubmit another ds230... I called the NVC they said a letter was mailed to my lawyer though my lawyer hasn't recieve any yet.... so just waiting for it. You have a quite old PD....maybe you'll be one of the very first blessed ones to have a schedule of interview;)

Please be aware that there are only 140,000 visas that will be available in July as per the July Bulletin.

There were 150,000 petitions for the H1-B visa that were submitted in just hours when they opened the window for accepting them. And then it was closed; immigration expected it to take at least a week, if not longer. Many that are under the EB-3 category are in the US already and are on the H1-B visa as they are in the IT fields, and those companies have in-house immigration attorneys there just waiting. And you can be sure that they will have couriers at the door when the offices open on the 2nd of July. The first is a Sunday, so the offices are closed. There are hundreds of thousands in the US, if not even more, that have been waiting for this as well, and they are already in the US.

So, it is not if another retrogression will happen, it still has not ended. The dates listed in the July Bulletin are not current yet, and will not be until July 1st. And they will be gone quickly. Consider this as a present for the large corporations that wish to get final immigration issues taken care of for employees that are already working for them before the fees go up significantly at the end of July. Do not expect many nurses at all to get thru at this time. Consider it a gift if you do, but do not expect it.

If you do not already have approval on everything, including the DS-230, it is going to be a very slim chance to get thru now. That is just how things are.

Since when the EB visa are based on a "first come first serve" basis (as in H1-B) we all have priority dates and if the EB-3 cattegory is Current right now it means that they need to assign visa numbers to cases who are in line.

I thought this is how it is working, I do not understand how people can get in line and what will be couried to them on the 2nd of July.

If it is on a first come first serve basis please inform us, and mabe we will be able to submit what is needed to be submited also on their doorsteps, what do you mean?

Hi pretty neirelle! Did they just ask for updated DS230 but not the other docs (birth cert/clearances etc) you already sent last October? I was afraid they will re-process cases again w/c were actually already completed (less than a year ago). Thanks.

Please follow any instructions on this notice. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. We process cases in the order we receive them. You can use our processing dates to estimate when yours will be done. This case is at our NEBRASKA SERVICE CENTER location.... "

Do you think I have any chance to get GC soon?

As I keep stating, do not look at PD date alone, but when the file is actually completed. Many times petitions are delayed for one reason or another. These are people that have the approval of the I-140 as well as have been in the US in most cases and working with a temporary visa that is not available for nurses. There were 150,000 petitions for the H1-b that were filed in just a couple of hours in April.

If you do not have a completed file there is no way that you are going to get a visa from this 140,000. They were not created specifically for nurses.

There are only 140,000 visas available for these that were re-capped. They are not just for nurses, but more for those that are in the final steps and are already in the US on another visa. Corporate in-house immigration attorneys are going to be grabbing up all of these visas in a very short time. There are only going to be very few for nurses. There are hundreds of thousands that are already in the US that have just been waiting for things to be current for them, and remember that in most other areas, the wait has been several years for them, so they are going to be jumping at this.

We saw what happened in April here with the H1-B applications for October starts, they were filled in just hours. The visa fees are going up significantly the end of July, so this is more as a favor to large corporations, not meant specifically for nurses in any way, shape or form.

Next question is why are you still waiting with a PD date from 2004 or 2005? If things were done as they should have been with completed files submitted, and bills paid when they were sent, then you should have been in the US already. This was not because of issues with immigration, but either your employer or the attorney that is in charge of your petitions. We see it all of the time.

hi....Yes, only the updated DS 230 form...my NBI clearance is also due on Sept. so i'm pretty sure they will ask for it...whoaa! got tired already on doing these things all over and over again. When it will end ?I need more patience....God bless to us...

pretty neirelle thanks for sharing. hope you'll update us with your case once NVC asks for anything else or just schedule you for medical/interview.. (like you, I was asked of new DS230--& I hope that's all that's needed before packet4).

Please update us on the progress of your case like timetable from re-submission of DS 230 to getting interview sked because your case will serve as a guide for us also waiting but whose PD will be current only July. My PD is Nov 2005 and case was completed August 23 but unfortunately got caught up in the retrogression. We want to know what happens to your case from the time the June bulletin came out until interview schedule.

When did your agency receive the request for re submission from the NVC. Was it in the month of May or June so we know when we should expect those requests for us waiting for the juky bulletin.
