If you are just at the beginning stage such as at the filing of the I-140 stage, I would suggest that your petition be filed using the premium processing so that by July, you got it approved (or denied). If lady luck strikes, you could be one of the many who could be interviewed.

This 2+ month window is also good for those who are already in the US and are changing their status. It will help them get an EAD, even if retrogression kicks in again in September or October.

There are so many ways to skin a cat, but there are only a handful of ways to get a "visa number".

The July Visa Bulletin is current from July 1, 2007 until the last day of July. It is only in effect for that month. Meaning that visas are not current today, not until this bulletin goes into effect.

And no one knows what will happen in August.

Retrogression has a little opening right now, but this does not mean that it is over, consider it an open window of opportunity that will not last long. Remember that most that are wishing for green cards also includes those under other visa categories.

And I still would not consider the AOS procedure for most. If you are not in the US already for 90 days for most countries, then you run the risk of not being able to get things submitted. You cannot come to the US and get a petition submitted the next day. There are time restrictions with that. So please do not consider coming to the US now to go thru AOS, it is not going to hapoen for most. Unless already in the US for a couple of months, then there is no chance and should not be attempted. To do so is at your own risk.

if you read the thread suzanne has posted retrogression is not over she gives a good explaination, visas that have been released cover everyone in the E3 catagory of which nurses are only a few so demand is high. For everyone it will be a case of wait and see

Your attorney is being quite honest with you. There are going to be many more applicants than there are visas, just like what happened in April here.

the retrogression is not over.

there are a certain number of visas that will be available. nurses are not under their own schedule as they were before. you are not lumped with very large numbers who actually have aggressive in-house lawyers that afre wishing to get things completed before the rates go up the end of july.

this is going to help those that have been in the us and waiting to go thru aos and they went to school here, and have met the time in the us requirements. for others that are planning to come to the us to try for the aos, don't. there will not be any visas by the time that you meet the requirements.

with the h1-b visas, they were gone in hours, with well more than the number of actual visas that were available. and this not going to be near that number.

and the us government has never said one thing about october, that is only the opinion of a certain law firm............nothing from the us government. and as we keep stating, if it does not come from the us government, it is not written in stone.

I-140 is also unavailable until september. So for those who are waiting for approval it will be another wait.

We can only pray and hope that retrogression will not be in the way.

I think you will find that I140 is still being accepted as it has nothing to do with visas. I140 has always been accepted it is just once NVC is involved has retrogression kicked in as no visas available

hello suzanne, been wondering about my case. I have a PD which is current this month. My agency told me that NVC requested me to submit an updated DS 230. I have my documents resubmitted in NVC last october 2006, so I did submit it. Why they are asking for it? would I have the chance of receiving packet 4? thanks for the reply...you're such a good help.
