I am sure that many of you do not want to hear this. But it is the actual truth. There still is no special schedule for nurses, and the Schedule A is not included in the Visa Bulletin.

That the dates are current for the month of July does not state that it is over. There is a huge number of applicants waiting for the green card, in addition to nurses, and they have been waiting as well. Remember that most that came to the US under the H1-B visa, are also included with the EB-3 caseload. And many of their attorneys are much faster at getting things done. Example: When the window opened for petitions to be submitted in April for the October 2007 H1-B visas, there were more than a 150,000 submitted in less than one day. And they were gone.

Not trying to burst any bubble, but trying to be honest on this. There are only so many visas available per year, never unlimited number. And this Bulletin does not go into effect until July 1, 2007. And those dates are only for that month and if you notice there is also mention that if the visas get used up that are there, then the dates will not remain in effect all month.

For those of you that got stopped in the processing just before your interview, this will be very beneficial for you. If your DS-230 has been approved and accepted, then this can be beneficial to you. For those that are just starting the process, remember you at the mercy of your agency and attorney and how fast that they will do things. We have seen multiple posts over the years of mistakes made with petitions that delayed things for quite a period of time. There is also a considerable raise in immigration fees going into affect at the end of July that will delay things for some people as the agencies are going to be holding back on paying of fees.

Those that have been paying their own way will find that they may get thru faster.

So please, do not make final plans to leave for the US until you actually have an interview date given to you. We saw what happened last fall to quite a few of you here.

Until there is another Schedule in place for nurses, the retrogression will not be over. Just an open window in the scheme of things, but definitely not over. Look at what happened even last month when the dates were moved up for the PD, you did not see a significant movement of anything. When money is needed to be paid by the agencies, everything drops to a crawl.

i dont understand this.

it is not a good news after all. i mean under the current system a small number of nurses will be accomodated. there are other professions on the line especially computer scientists who are waiting.

moreover, it would likely be the biggest retrogression event in the coming months may be on august or october. i hope philippines might be able to move a little farther.

india and china could possibly meet retro fever.

i absolutely agree. i would say that this "break in the clouds" is not meant for nurses at all, but mostly for the tech workers set to undergo aos. nurses are the probably the last thing on the list, sort of an afterthought. the world does not revolve around nurses, there are thousands of eb3 professionals with their formidable lawyers ready to jump at the gun. the visas will last only a few hours, just like the h1b. there are just too many people crowding in to get their green cards. this one's not meant for most of the prematurely celebrating nurses. the retrogression will probably hit in july, when the visas will vanish in a flash, in just a few hours. very sobering indeed. :nono:

It's difficult to speculate on what and how USCIS does things. We have no control over it. The process should be accepted as it is. Nothing we can do about it. but watch and wait, wait, wait. :nono:

This is the only official word so far. This is of course taken from the current visa bulletin.

All Employment Preference categories except for Third "Other Workers" have been made "Current" for July. This has been done in an effort to generate increased demand by Citizenship and Immigration Services (CIS) for adjustment of status cases, and to maximize number use under the annual numerical limit. However, all readers should be alert to the possibility that not all Employment preferences will remain Current for the remainder of the fiscal year. Should the rate of demand for numbers be very heavy in the coming months, it could become necessary to retrogress some cut-off dates for September, most likely for China-mainland born and India, but also possibly for Mexico and Philippines. Severe cut-off date retrogressions are likely to occur early in FY-2008.

i have a friend whose 1st I-140 was denied due to some typographical error by the paralegal. they re-filed another I-140 and I-485. her 2nd I-140 was approved a few months after re-filing. then on October 30, 2006, she sent me an email saying her AOS was approved that day......2 days BEFORE retrogression came in on November 1, 2006.....

a nurse coming from the Philippines stand to have more opportunity of getting the green card due to the fact that we have a lower EB-3 visa demand as say China and India whose EB-3 visa numbers retrogressed as far as 3 years for the last June 2007 visa bulletin. Also the fact that majority of I-140's coming from the philippines are from Nurses with few PT's and few from the IT sector.....

i want to give nurses some hope not false hope. for all of those who have filed last year, you have a small window of opportunity. But as what Suzanne noted, do not sell your car, house and carabao yet.....nothing is certain until we get the physical greencard or after passing the Embassy interview.

You need to read the other threads on this - retrogression is not dead - there is no schedule "A" visas on the bulletin. Yes visas are current but they are not exclusively for nurses or the other original schedule A jobs. Therefore you will be in the pot with all the other skilled workers & the numbers are likely to be used up fast. It will depend on where you are in your application and what date you filed.

It will be good for some that there are visas available again but for most of us we still need schedule "A" to be re-instated for it to benefit us.

so in short visa is limited to 140,000 applications only and good until October (we never know what lies with october bulletin). it is like whichever comes first...

That the window for the 'relief of retrogression" is very small is clear. What are your predictions as for the dates to which the cases will be thrown back when retrogresion hits again? Last time it was 5 years back, am I right?

Also, the new visas become available every quarter or how?

It is not anything being thrown back, it is not over. This is just a small bubble or present to the big corporations in the US that are not happy with the increase in visa fees. We saw what happened in April when the window opened for the H1-B visas, they were gone within an hour or two. Same thing is going to happen now, there are many that work for companies that have in-house immigration attorneys, and they will have couriers first in line when the doors open to accept the petitions.
