Retrogression Is Not Over

I am sure that many of you do not want to hear this. But it is the actual truth. There still is no special schedule for nurses, and the Schedule A is not included in the Visa Bulletin.

That the dates are current for the month of July does not state that it is over. There is a huge number of applicants waiting for the green card, in addition to nurses, and they have been waiting as well. Remember that most that came to the US under the H1-B visa, are also included with the EB-3 caseload. And many of their attorneys are much faster at getting things done. Example: When the window opened for petitions to be submitted in April for the October 2007 H1-B visas, there were more than a 150,000 submitted in less than one day. And they were gone.

Not trying to burst any bubble, but trying to be honest on this. There are only so many visas available per year, never unlimited number. And this Bulletin does not go into effect until July 1, 2007. And those dates are only for that month and if you notice there is also mention that if the visas get used up that are there, then the dates will not remain in effect all month.

For those of you that got stopped in the processing just before your interview, this will be very beneficial for you. If your DS-230 has been approved and accepted, then this can be beneficial to you. For those that are just starting the process, remember you at the mercy of your agency and attorney and how fast that they will do things. We have seen multiple posts over the years of mistakes made with petitions that delayed things for quite a period of time. There is also a considerable raise in immigration fees going into affect at the end of July that will delay things for some people as the agencies are going to be holding back on paying of fees.

Those that have been paying their own way will find that they may get thru faster.

So please, do not make final plans to leave for the US until you actually have an interview date given to you. We saw what happened last fall to quite a few of you here.

Until there is another Schedule in place for nurses, the retrogression will not be over. Just an open window in the scheme of things, but definitely not over. Look at what happened even last month when the dates were moved up for the PD, you did not see a significant movement of anything. When money is needed to be paid by the agencies, everything drops to a crawl.

ok. rkm has a point, i am no longer excited of what's goin on because the case here is the number of visas to be issued. by july 1, i am sure nvc will be drowned with truckloads of mail couriers from all over the world. i bet it.

then these ds230's will be consumed into smokes.

that's hilarious. that's about the funniest viewpoint i've seen here, and we need to laugh at ourselves after all the anxiety with the slippery eb3 visas and get rid of most our worries. laughter is the best medicine for retrogressionitis after all you've done what you can, and the rest will be up to the lawyers, the nvc and plain old-fashioned luck.

How long did this current retrogression actually last for? Or at least how long were the visa's put on hold? I'm just wondering as it may be a reflection on what happens in the future when I'm about to apply.

the retrogression isn't really over, just some visas released but will probably go overnight. No telling really what the future will bring whilst we wait for it to be sorted but atleast visas are still being released to each country so a lot depends on demand

I have an agency interview next week and was made to believe that I can go to USA maximum 3-5 months time and work for this certain hospital which was given a special privileged to hire nurses quickly without any problem of retrogression. This hospital is in Washington D.C. Given my long experience in Med-Surg, NCLEX passer and VISA sceen certificate holder, I was put in their fast track group. The catch on this is; I can bring my family but my husband cannot work for 5-6 months. Once in USA, they will apply me for Green Card and once we have it, my hubby can then apply for a job. I am a bit hesitant on this but I will still go for that interview and get the full details before I signed on that dotted line.

Sounds like a working visa on a hospital in a very depressed area of US where US nurses never bother to go to work.

I've mailed my ds230 complete with all the rerquirements. My fee bill has been paid together with my family. It's all up to NVC now. You think, with all the volume of applicants you spoke of, I may be included in this small window of yours? I'd love to be included in this Hiccup.

The question for you is when you had it submitted? Remember that you still need to have approval of the DS-230, just like you went thru for the initial approval, so without that in fact being done, there is not one single chance that you will be able to get a visa out of these.

July 1 is actually a Sunday, so they will not be accepted on that date. There are going to be enough couriers standing in line at immigration offices to hand deliver the petitions. There were more than 150,000 submitted like this just in a couple of hours in April when the doors opened for the H1-B visa submission. Expect the same on July 2nd.

The rates are going up significantly the end of July, so there is also an additional push on to get this done now.

And if the DS-230 has not already been submitted and approved, then there is no way that anyone will have a chance at a visa at this time. What I am talking about being delivered are the petitions for those that have been in the US for a few years, and under the H1-B visa. Many have been waiting for their PD date to be current so that they can go onto the I-485, etc. This is where the thousands are going to be submitted on the July 2nd will be from, not from out of the country. This is what I have been trying to explain to all of you. And that is why there will not be many visas for nurses. There are two completely different procedures for those out of the US, and those that are in the US. And to submit the initial I-140, that takes weeks to gather the required documents to be submitted in most cases, it is not an overnight thing that can happen.

Sorry, but something is being done illegally here. Unless you are from Canada and going thru with the TN Visa, then this is not something that you can do. Washington DC does not have any facitilities that are under the H1-C visa, at least that I am aware of. Something is not right here, and any short cuts always turn to bite you on the butt.

This is something that you never want to do. Find out the specifics as to the type of visa that they are bringing you over on. And sorry, but there is no way for your spouse to be promised to be working in five or six months, there still is a retrogression in place, and he would be getting a green card based on you going thru the AOS process. That is where the knife is thrown into this. This cannot be done at this time, the retrogression is still in effect.

Do not do it, it can get you deported....................something is not right with that. Only way if on TN Visa for you, but again, no work for hubby this year.

Noticed that you are in the UK, not a thing that will permit this. Please send me the details of what they have offered via pm or via e-mail. I truly want to see what someone has come up with to try to get around immigration. But please, do not sign it.

It stated October 31, 2006 and is still in effect. It is not over. And the Schedule A for nurses has been gone since the February Bulletin came out in January.
