Retrogression Is Not Over

I am sure that many of you do not want to hear this. But it is the actual truth. There still is no special schedule for nurses, and the Schedule A is not included in the Visa Bulletin.

That the dates are current for the month of July does not state that it is over. There is a huge number of applicants waiting for the green card, in addition to nurses, and they have been waiting as well. Remember that most that came to the US under the H1-B visa, are also included with the EB-3 caseload. And many of their attorneys are much faster at getting things done. Example: When the window opened for petitions to be submitted in April for the October 2007 H1-B visas, there were more than a 150,000 submitted in less than one day. And they were gone.

Not trying to burst any bubble, but trying to be honest on this. There are only so many visas available per year, never unlimited number. And this Bulletin does not go into effect until July 1, 2007. And those dates are only for that month and if you notice there is also mention that if the visas get used up that are there, then the dates will not remain in effect all month.

For those of you that got stopped in the processing just before your interview, this will be very beneficial for you. If your DS-230 has been approved and accepted, then this can be beneficial to you. For those that are just starting the process, remember you at the mercy of your agency and attorney and how fast that they will do things. We have seen multiple posts over the years of mistakes made with petitions that delayed things for quite a period of time. There is also a considerable raise in immigration fees going into affect at the end of July that will delay things for some people as the agencies are going to be holding back on paying of fees.

Those that have been paying their own way will find that they may get thru faster.

So please, do not make final plans to leave for the US until you actually have an interview date given to you. We saw what happened last fall to quite a few of you here.

Until there is another Schedule in place for nurses, the retrogression will not be over. Just an open window in the scheme of things, but definitely not over. Look at what happened even last month when the dates were moved up for the PD, you did not see a significant movement of anything. When money is needed to be paid by the agencies, everything drops to a crawl.

The dates are not written in stone, and they are always changing. There are hundreds of thousands that are waiting for petitions to be approved.

This is why I keep stating that the retrogression is not over. The dates that are listed in the July Bulletin do not go into effect until the first of July and that is a weekend day.

I absolutely agree. I would say that this "break in the clouds" is not meant for nurses at all, but mostly for the tech workers set to undergo AOS. Nurses are the probably the last thing on the list, sort of an afterthought. The world does not revolve around nurses, there are thousands of EB3 professionals with their formidable lawyers ready to jump at the gun. The visas will last only a few hours, just like the H1B. There are just too many people crowding in to get their green cards. This one's not meant for most of the prematurely celebrating nurses. The Retrogression will probably hit in July, when the visas will vanish in a flash, in just a few hours. Very sobering indeed. :nono:

There is no retrogression to happen again, it is still in place for nurses. Those dates that are listed in the July Bulletin do not take place until July 1, 2007. They are not in effect right now. And they never posted how many visas would be available that have been re-capped. But you can expect them to be gone in a blink, as fast as they are there, they are going to be gone.

The only ones that have any chance of getting a visa from this number are the ones that have everything completely done and approved and are just waiting for a date of their interview.

For any of you that are thinking of coming to the US for the AOS, don't. There is no way that there will be visas available from these when it is time to have your documents submitted.

We do not even know what will be in the August Bulletin. In April, when the opened the time for submitting the H1-B visas, they were expecting them to be available for weeks. They were gone in a couple of hours, and that was 150,000 petitions that were submitted. You are up against all of the corporations that have in-house immigration attorneys.

Just is not going to happen to make a dent for nurses at this time.

I've mailed my ds230 complete with all the rerquirements. My fee bill has been paid together with my family. It's all up to NVC now. You think, with all the volume of applicants you spoke of, I may be included in this small window of yours? I'd love to be included in this Hiccup.

there are many people even further on than that who had interview dates given and cancelled last november when retrogression hit, and people who had the telephone message that their file had been sent to the embassy who didnt get interviews, so who knows, who is going to get through, hopefully you are far enough along to get through

No one knows. Not even USCIS knows at the moment. The cut-off dates will depend on up to w/c date they were able to give visas and will also depend on the country as some countries have higher demand compared to others.

Thanks for the reply Lawrence! I was just hoping it will not retrogress again like 3-4 years:o.... like last months VB for PI is June 05 and they weren't able to consume the visas that's why they made it current for this month.

Sorry, but not sure where everyone is coming up with October, the dates in the Visa Bulletin are only valid for that month, we do not even know what will happen in August. But if what happened in April is anything like what I expect to happen now, the visas will be gone in days, not months.

Sorry, but that is not the reason. It has much more to do with the issue that the rates are going up so much at the end of July. More with that over anything else.

Notice, that the visas were not recapped to give to nurses, but more for those that are in the US under the H1-B status and they have been waitinf for several years in many cases for this. So it does not happen right now immediately for anyone. Many of you are looking at only how things affect nurses, and that is not the case with immigration right now.

Here's a scenario: the visas are all consumed in July, as early as Day One, Retro is back in greater force and the EB3 category becomes UNAVAILABLE in the August Visa Bulletin. All unapproved DS 230s are returned to their respective lawyers. We all get ready to pass our DS 230s again in the next break in the cloud of Retrogression. It's a funny loop, sort of like a dog chasing it's tail. It's tough, nobody likes it, but hey, that's reality for you. And it will be the normal state of things for nurses, unless Schedule A or something like it is activated by law. If we know and accept the worst case scenario, we can cope better when it finally hits us. We can then laugh, shrug it off and move on with our daily lives. Let's hope for the best and brace for the worst. :nono:

ok. RKM has a point, I am no longer excited of what's goin on because the case here is the number of visas to be issued. By July 1, I am sure NVC will be drowned with truckloads of mail couriers from all over the world. I bet it.

Then these DS230's will be consumed into smokes.
