I am reiterating my previous statements. One can use an approved I-140 unless revoked by the employer. the I140 is employer specific and an approved I140 can always be revoked by the the employer. If this is the case, the Priority Date can not be used this came from Murthy, an well known US immigration lawyer: --------- Question: If one has an approved I-140 in EB3 from the current employer, can this priority date be captured to file a new EB2 in PERM by another employer? Answer: The general rule is that this is certainly possible as long as the prior employer does not revoke or cancel the earlier LC and the I-140 petition approval. In general, if a petition is supported by an individual labor certification issued by DOL, the priority date is the earliest date upon which the labor certification application was filed with DOL. In those cases where the alien's priority date is established by the filing of the labor certification, once the alien's Form I-140 petition has been approved, the alien beneficiary retains his or her priority date as established by the filing of the labor certification for any future Form I-140 petitions, unless the previously approved Form I-140 petition has been revoked because of fraud or willful misrepresentation. This includes cases where a change of employer has occurred; however, the new employer must obtain a new labor certification if the classification requested requires a labor certification (see the section on successorship of interest). -------------- A new I-140 petition from a different employer is clearly a change of employer. An approved I-140 from company A means you are an employee of company A. If company B files for your I-140, then it means you are an employee of company B. Remember that your employer would only file for I-140 AFTER the person signs a contract saying he is going to work for that company. you are clearly WRONG

I had less than 5 minutes to reply to your post earlier that is why I asked you first for your reference, I do not see anything wrong with that because you were the first one to object to my post.....Unfortunately, you were not able to produce your reference because NONE EXIST. and now you are saying my advice is "the dumbest" you have ever seen..... Allnurses.com exist so that nurses from the US and around the world could communicate and exchange ideas about everything nursing. from NCLEX to immigration to retirement. Nurses are supposed to be educated enough not to use sentences such as "dumbest advice I have ever seen". but I guess are the exception. this is a forum for educated people who knows that this should not be the arena for personal grudges. Im an Asst Head Nurse in one of the biggest hospitals in NY. Never did I say to my RN's, LPN's and Cna's that their advice is the "dumbest advice" in the event they suggest something. Nor do our Chief Nurse Executive. that is why she is deeply loved.... as a last note, thanks for posting my reference as I did not have enough time to post it this morning.....you should be humble enough to admit you were wrong.... Goodluck to your career.....you would need lots of it :chuckle

WRONG! where did you got this information? If an approved I140 is revoked by the employer, you CAN NOT recapture the old priority date. that is the reason I suggested Edwann to make sure it is not revoked. Old priority dates can only be used if the employer has not revoked the original I140. that is the trouble i am talking about on filing a 2nd I140 if his immigration lawyer would not be careful about this information.....small things are magnified when one is dealing with the USCIS. one can file multiple I140's as long as one is not approved and does not intend to use a revoked I140 old Priority Date. If you are not knowledgeable enough regarding this topic, then I suggest you reply with a toned down post.

You have to clarify with your employer first regarding the job offer if it still exists or not. you have to make sure that your employer withdraws the I-140 in case the job offer was cancelled. No, a person can not have two I-140 filed simultaneously.....One might end up with two different alien numbers (A files) and this could cause a lot of problems. I work in NY and there are a lot of hiring freeze for nurses. Just make sure the agency you want to work for is legit.... God bless

Edwann, To my knowledge, the I-140 is employer specific if filed under Consular Processing. AC21 portability (wherein an approved I-140 can be used by an adjustee to change employer if his I-485 is pending for more than 180 days) can only be used when a person filed his I-140 via Adjustment of Status and NOT Consular Processing. Unfortunately, you have to find another employer......goodluck and God bless

Any good news from new grads in NYC?
that could be the situation a few months ago, but it is a different scenario now in the entire 5 boroughs......2 hospitals in Queens just closed with hundreds of experienced RN's out of job. I have 3 friends with at least 1 year experience who have applied 3 months ago in more than 15 hospitals in the 5 boros but could only get part time jobs.... im not trying to discourage you but the job market for new grads are going to be grim in the next few years

To all foreign nurses in the US, will you retire in US or go back to your homeland?
Even if there is gonna be a depression (although im pretty sure we would NOT have one if a bailout happens) I am NOT gonna retire in the Philippines. I have only been here in the US for 2 years as a legal resident but like pinoyNP, my present life is already intertwined here in the US. my wife just gave birth one month ago and I know that we would be raising our children here in the US. they in turn would raise their children here in the US. I dont think my children would live with me and my wife in Manila. we are not US citizens (we would be applying soon) yet but our home will be here in the US for the next 30 years at least. we would probably visit Manila a few months every year but most likely spend most of our time here in the US after we retire. one more thing,I get pretty angry whenever somebody trashes or puts America down.

majo-villamer, LPN's could not be petitioned for a greencard. Im sorry but that is the truth....you can only work in the US as an LPN if you already have a greencard or you are a US citizen. open your eyes to the truth.....

the biggest hurdle you have here is the unavailability of immigrant visas.....no relief is in sight for the next few months.....ive had acquiantances fly here to NY trying to do the same thing only to realize that there is a retrogression in place.....they not only wasted time but wasted money as well as they dont have a choice but to go back to Manila after both of them failed the NCLEX.....im not really sure what stage of the NCLEX application you are right now but i wish you the best of luck.....
