Retrogression is confusing me!

Hi all,

Well I have been lurking on this forum for a while now, and fully aware of the retrogression that is in place. I have prepared myself for the fact that it will be a long time before I could get to the states, maybe even 7 years..

However, I am just reading todays nursing standard, and there is an ad stating in big letters " BEAT THE RETROGRESSION "...and a recruitment company is now recruiting for nurses to go there, saying if they have CGFNS & NCLEX they qualify for fast track, and will get them there in 9-15 months..???? I now dont understand.

I have just emailed them, to ask if this is a blatant lie, as I am now confused with all the conflicting information I am recieving. Aparently this recruitment company isnt an agency as such, as they put you in direct contact with the hospital..and it also looks like you would have to commit to an 18 month - 24 month contract..

I guess I just dont know what to believe any more..

What type of Visa did they issue you?

They got your family a Visa also

The member doesn't explain what visa they received. GC are retrogressed and current processing times are 2001 or 2005 depending on where you was born. Very few visas allow family to work once in the US. You can only file I140 at the moment and that doesn't give permission to work in the US and if they have only just filed for GC then they have only filed I140 and still have several years waiting ahead of them to get a GC. I485 (AOS) is not being accepted at the moment if you are the applicant looking for a work visa. For it to be accepted the visa which generally for nurses is EB3 has to be current

I can not give any immigration advise on here but I can give my opinions on what is currently happening with the visa bulletin. If any doubts see advise from a immigration lawyer that has experience in bringing nurses to the US.

Probably what made it to the US had was an H1-C visa...wherein it is not affected by the retrogression. But it is very limited and is only awarded to hospitals who are really in dire need of health workers.

nurse2bmonique21 & redranger - i do not work for the company i work for a hospital in the us i did work as a part time rn interviewer for an american nurse agency in london.

branyan - thank you as you seemed to know that greencard is not the only route to the us however h1c visa is very limited but it is possible. i also heard about nurses who have come to the us on a h1b.

i would suggest verify & research all your information thoroughly, ask the right questions before you sign up with any company or hospital as i was under the impression that a nurse could only work in the us on a greencard and the more i asked around the more confusing the information was.

all i know me and my family are very happy to start our life in the us while we wait for the greencard.

You still haven't mentioned what visa you have in the US? GC are not being issued unless you have a PD of between 2001 or 2005 depending on where you was born or you have met the criteria for EB2 which new grads will not meet

We know that there are other visas like H1b and H1C.

H1B is a specialist visa and new grad nurses will not meet criteria. H1c expires at the end of this year with no indication that they will be renewed and currently only 14 hospitals have H1c status

@ made it to the US To help clear up things, can you tell us what kind of visa the recruitment agency gave you..I really can't think of how you or your recruitment agency were able to beat the retrogression. Thanks.

I was in contact with that company, they don't allways reply promptly. But main thing is, they offered the H1B visa for nurses (that's the so called "beat retrogression" program), once in the country they promised employer would file for Greencard.

That's it, no big secret.

sorry for late response i dont get on the internet often. as branyan mentioned it is a H1C visa and my greencard was filed when i completed 3 months of employment and a successful orientation.

Be aware H1C is only done at 14 hospitals and are up for review in 2010 and no guarantees that they will be continued. If not what are you going to do to stay in the US? as just filing for GC will not allow you to stay and work because you can not file 485 at the moment
