I have some questions on the H1B visa. My agency is saying because I have a bachelors degree in Behavioural Psychology they do have some jobs available in mental health that require a bachelors degree and we can apply for the H1B visa. I am sceptical from all I have read here.
I am worried what happens if the H1B visa is denied I am currently on F1 status and that would result in me having no visa and having to go home right?
Also if I do get an H1B visa they are only temporary for 3-6 years can I apply for the EB3 visa while on the H1B visa so I can switch visas to a permenant green card later?
Also I keep seeing it written that the wait for an EB3 visa is going to be "several years" I am not familiar with that term and to me that means it will be at least 7 years till I get my visa is that what "several" means? I know their is not an exact time frame for getting a visa but I was thinking it was going to be average 2-3 years not 7!!!
its a scam i have been to that to the point ive sent via fedex all the required documents. good thing i did not include the 2000USD they demand. please pm me...il help you...up to now they are threating me that i really need to proceed with them because i have my signature affixed in the contract...but i still believe that i wont be held liable because its a void contract ab initio....as if no contract existed...there's no such thing as what they are bragging about...H1B is only offered to special area nurses with 2 years or more in the field...think twice...suggest you read more about visas...
If you have a masters degree, you'd try for an EB2 green card, not a H1B visa (unless you're from india or china, which are still retrogressed in that category).
The cap-exempt just means they don't count in the limit, so they can be applied for at any time during the year. It's usually universities or non-profits that are eligible for cap-exempt visas. It's quite expensive for the employer.
DO nurses required to fill up Form 9089? or not anymore since nurses were under schdule A....

I have an immigrant petition under EB3 which is of course taking so loooooooong.......can an H1B be filed in my behalf WHILE I maintain the EB3 petition? cAN AN h1B be filed by the same employer?PD MAY 2006
Sure, the employer can file for the H1-B, but they have to pay 100% of the costs of it and cannot have you pay for any of it, even down the road. Still does not mean that you are going to get it, the H1-B visas have caps to them and the ones that do not are still not unlimited, the facility has a limit as to the number that they can use.

Nurses are under the EB-3 category, and this is what the Schedule A was under. Anything that was required for the green card, is still required to be submitted now.

What company is this? It's pretty simple what they're asking you. If you don't understand what they're saying then I'd say that you don't have a good grasp of the English language, and neither do they. If you copied word for word then their English grammar and sentence structure is poor. I'd be skeptical if I were you. If I were you, I wouldn't send them anything. Talk to an immigration lawyer if you want it done right. Best of luck to you.
Update, this year (2009) did not reach the quota of 65,000 excluding the 20,000 working visas for advanced degree holders as of april 8, 2009. Say I applied (as dialysis nurse) for one under standard processing, do I have a good chance of grabbing one? I have all the requirements VSC, ielts, nclex, ces for illinois, etc. The facility that sponsored me is in Illinois.

I am just wondering now how come the cap H1B visas did not reach quota? What could be the possible reasons for this unusual turnout? Anyone?
Current US recession and many jobs are being laid off. Any company using H1b will have to prove that they can not employ a US citizen or legal resident and with job unemployment high that will be hard to do
Also last year a survey discovered that the H1b wasn't being used properly ie was being abused and the government will probably be looking more closely

Ma'am Suzanne, I have a question regarding cap-exempt H1b visa. What is it? Because i saw in a news ad here in the Philippines of an agency offering a US-masters program for nurses, and they are practically bragging of bringing one faster to the US as they will process you with an "cap-exempt H1B visa". Is there really such a thing? Is it a way around retrogression? Please help...
