I have some questions on the H1B visa. My agency is saying because I have a bachelors degree in Behavioural Psychology they do have some jobs available in mental health that require a bachelors degree and we can apply for the H1B visa. I am sceptical from all I have read here.
I am worried what happens if the H1B visa is denied I am currently on F1 status and that would result in me having no visa and having to go home right?
Also if I do get an H1B visa they are only temporary for 3-6 years can I apply for the EB3 visa while on the H1B visa so I can switch visas to a permenant green card later?
Also I keep seeing it written that the wait for an EB3 visa is going to be "several years" I am not familiar with that term and to me that means it will be at least 7 years till I get my visa is that what "several" means? I know their is not an exact time frame for getting a visa but I was thinking it was going to be average 2-3 years not 7!!!

EB3 has been under retrogression since Oct 2006 with no telling how long it will last and it is decided on where you was born. If born in Philippines and rest of world (not including China, India and Mexico) then current processing times are 2005 CIM are further regressed. Dates can be found on the visa bulletin. Dates can vary by both going forward or backwards. Expect the option to adjust your status to take a lot longer due to the huge amounts of applications put in when the window opened for a very short period last July. Your employer if you have H1b can put in for GC for you but will take years depending on the visa bulletin and if you move jobs you will have to start all over again with GC application
Has anyone any other info about my specific questions on F1 being cancelled if my H1B is denied? And also what "several years" means in the usa?
I do not think F1 will be cancelled if H1 is denied as long as you meet F1 requirements and still in study. The best ones to ask would be International advisers where you are doing your schooling. Several years means what is states. If you are looking at AOS then be prepared for something over 2 years and longer as 800,000 applications was filed in July 07 when the window opened for a very short period and only approx 140,000 visas are available annually, some of these applications maybe dismissed if not complete as was stated when the window was opened and forced to stay open. Things may change but I can't see it happening for a while especially as it is an election year in the US

There are dozens of nurses from your country appointed in June 2008 who have already got their visa approval under FAST TRACK EMPLOYMENT & VISA PROCESS program that we have launched in view of retrogression and backlog work. We complete this visa process in three months and had you sent you documents on 28th June 2008 then by now you were very nearly reaching your job place in September end.
If you still interested in this job and want us to process your visa under shortest possible time then you send your complete documents with signed contract and with financial commitment bank draft of 2,000 USD to our New York Office by DHL or FedEx courier service. From the date of receiving your documents with all requirements including 2,000 USD bank draft (as security deposit financial commitment) we can assure you that your visa with work authorization will be arranged in three (3) months time from that day"

What visa have they applied for you? There is no fast track of visas so am a bit suspicious there

This sounds like a scam to me. The big red flag is the demand for $2000. Of course, the extremely poor quality English could be another. Given what has already been written here, I would be very suspicious of their claims.

Scam. And nothing more than that. Do not send them any money and please forward a copy of this to the US Embassy where you are located.
There is no fast processing of anything, the green card has been under retrogression, and the H1-B requires that the employer pay 100% of the expenses.
This company needs to be closed down and quickly. They are hoping that the nurses are gullible and will believe everything that they are saying, but you will never see that money again.
Smart move that you did not do a thing with them.
Oh my God, I just sent my documents yesterday with my affixed signature on the employment contract. Please help me what to do now.
Oh my God. good thing I never send any amount. What I am worrying about this time is my signature affixed on the contract of employment. I believe that the agreement is invalid ab initio because these is a scam. Please someone help me.
Thanks suzanne and silverdragon, I called the US embassy this time and they want me to call POEA of Philippines.
Send them a letter immediately cancelling what you have signed. And hold on to a copy of it.
Always ask first before doing anything, never let any agency tell you that you need to do something right away. And whatever you do, do not send them one penny.
