A few months ago I was unjustly fired after a resident died, after my shift, and after she had been released from the emergency room. She had trouble swallowing something at lunch and another nurse suctioned her.

I was accused of neglect and reported to the state.

I only found out about it because I got a letter back saying, and I quote, "There is insufficient credible evidence to support that you are responsible for the alleged incident." Thank goodness for my unit clerk, who refused to change her story after being requested to by the DON. She told him, "I told the truth, and I'm not changing it."

Luckily I was cleared, but if I had to be fighting right new - whew!

Ok, so if I am to graduate in May, should I get coverage then, or should I wait until I take (and hopefully pass) the NCLEX? Because I will be working as a GN for awhile...

Thanks, everyone, for your support. It was a bad experience to be fired, lemme tell you! I came close to joining the "I'M LEAVING NURSING FOREVER!!!" threads.

But I didn't. And there are good facilities out there.

You can't do that in a civil deposition. Letting someone know that you have insurance is not something that is criminal, so you must answer the question truthfully.

You cant, in court, simply say "its none of your business, its not pertinent, etc...." its not up to *you* what is pertinent, or what is anybody's business.. its the judge's . And also up to your lawyer to object to whatever question *he* deems out of line...

But, "do you have " is a perfectly benign, and appropriate, question to a witness in a malpractice case....

I am thankful you posted this issue. I have been kicking the idea of around for a while and most people I talk with tell me I don't need it. After reading this I am convinced it is a small price to pay for my security. Sending my application in this week!

In the newspaper the pond scum sucking lawyers are running ads "Have you been injured or mistreated at a VA or military hospital, if so call us. POND SCUM LAWYERS at 1-800-FOR-SCUM. " I let out a groan when I read it. This ad has never ran before the Walter Reed business. I am no where near Walter Reed. They are scouting clients from the local military and VA. I'm not saying that the injured persons don't deserve compensation, I'm saying there's going to be a whole lot of fishing expeditions going on.

2) Judges don't like it when people try to play games and hold back information. And you definitely don't want the judge to be upset with you.

If they're coming after you just because you have insurance, chances are the judge is going to see through that and rule in your favor. But, if you try to play games and aren't honest and up front with the court or during a deposition then ...

That's really going to hurt you. It's going to look deceptive and, quite frankly, it is. Then you'll end up looking like the villian who's trying to hide something instead of the two bit money grubbing lawyer who's hassling you just because you have insurance.

I've been in court enough to know that you do not, under any circumstances ... try to play games with a judge like that. You'll lose the case on that alone.

i think it is a fantastic thing that you posted this thread! it seems that many here have been advised against carrying their own insurance.

i agree! i had let my insurance lapse, just forgot to renew. thanks suesquatch. as soon as i read this thread, i went on to nso's site and put in my insurance request. as of today, i'm covered.
