Partner locks up W2s prevents LPN from renewing license.

Hello Nurse Beth,

I have an odd question regarding an audit in WV of my LPN license. My license was inactive when I received notice of the audit, but I need to satisfy the proof of 400 hours before I can renew (& it’s been a long time-I was afraid to tell the board member that I am in a domestic violence situation and it was during COVID lockdown.) I am afraid it will count against me, but he keeps all of my W2’s and important mail locked up & My only other option is $9,000 they want for contact agreement. I was encouraged to look for paystubs, but he has beat me to it-it would be great to be able to get my LPN back & GET OUT OF HERE! (Yaaass) have called all 6 employeers (PRN-TRAVEL) and no dice. Am so scared, but your answer would be more than welcome and infinitely appreciated!! Thanks!

I'm so sorry about your situation, and you are right, your career is the key to becoming independent. 

The first thing is your safety. You have already been in a violent situation and your partner is trying to control you. Consider that as you try to get away, or even get a job, his behavior may escalate. I don't know where you are in WV, but there is a Hope Inc Domestic Violence Center in Clarksburg (304 624 9835).  You could call to find out what resources are near you.

Getting proof of your worked hours is a priority. You can create a Social Security account online which will have a record of your earnings.

You can also be more persistent with the employers. You can go in person to one of your employers and ask for the information. It's easier to brush someone off on the phone than it is in person. Chances are that out of 6 employers, someone in one of the HR departments is sympathetic and helpful. Tell them part of your story if need be "My partner has locked up my paperwork and I need to renew my license".

What was your reason for thinking you had to tell the BON about your domestic violence situation? Don't divulge information that is not required, but do answer all questions truthfully on your application.

Think about getting a post office box for your mail to keep it safe from your partner. If you are able, try to put some money aside and get your own credit cards.

Whenever you change your address, be sure and notify the BON. 

I don't understand the $9,000 contact agreement option, so I can't comment on that except to say that's very expensive! Who is asking for $9,000?

Thank u so much, Nurse Beth-I’m going to try the # and also I feel a bit more emboldened to talk to the BON. The $9k is my punishment for not proving I worked 400hrs during the 2 years of the audit. It was several years ago, but I am going to try to talk to the POE’s again-one was so helpful she called the BON to let them know that they don’t keep the records longer than a year. In response I received an email encouraging me to find my paystubs or pay the $9000 fine that represents the hours I have to prove I was paid, I suppose-it says it’s a contact agreement. Thank you for the helpful info-I am just petrified to speak to the BON because I’m afraid they might keep my license because I let my situation get this bad. I can understand if they presumed that since I haven’t helped myself so far, they might not trust I would help a patient in the same situation… I know I would do fine, but the BON here seems intimidating-I have to take the chance, though. I was working with a case manager at the WV DRS due to my disability getting in the way and she had been calling the BON & they worked with her helping me get something to show work hours. She retired 3yrs ago & I have had 4 newbies quit right away, so I think I need to ask for help elsewhere now. I think the SSI form you speak of is what I want to ask if I can use to show hours-It is 2yrs salary over $9k, so that may work…??

I might that if OP is paid electronically they ca establish and account with the company that send out the check and gat access to their pay stubs and W2. And abusive partner need never know.

I wish you the best of luck in getting out of that situation!  As far as the partner, karma will bite them in the butt sooner or later.  Get yourself to a safe situation.

I don't have anything to add, but most HR departments will have your pay stub information, even if they need to email it to you or something.

Did you have Direct deposit? 

A tax return? 

Your employers surely have records going back more than a year.  Get a lawyer to force them to produce such records. 

Social Security has all of the records. 
Get the records from them.

Thanks for ideas; unfortunately he still refuses to disclose any details about whatever plans he had for them. Suffice it to say, they weren’t even filed for a refund. Too bad. The $ would have helped put tiny dent in my consent agreement fines… Lesson learned! ?

Your earning information belongs to you not him. You can contact the IRS and request W2 statements of the years in question. Get a cheap PO box and have them mailed there. Yes you mauy owe on those earnings but you can also use them to prove feduciary abuse. If he was in charge of file joint tax returns he can go to jail. My first husband did sometyhing similar ands I was able to get all my documents from the IRS who were super helpfulBecause we were divorced I only had to pay taxes on my portion of those earnings which was they then offered me amnesty on at 25 cents on the dollar.
