October visa bulletin is out today.

It is not current yet.It still has cut off dates and no schedule A in the list.

My 1485 is pending at texas service centre and it says:

Current Status: Response to request for evidence received, and case processing has resumed.

On August 17, 2007, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done. What are the chances of being approved .

Any info on that wil be highly appreciated.

This is only good for those with old PD. In most cases those in the US with old Labor Certification can benefit from this. And this applies to other professions as nurses don't need LC to apply for I-140.

Certain analysis shows that the October Visa bulletin does not reflect the real status because the Department of State is still waiting for USCIS to finish receipting of the adjustment applications that surge this July and August due to the July VB fiasco. After the receipting, this is when only DOS will get the real picture and may find that some countries like the Philippines are not really that retrogressed.

We can expect big movements in the future, maybe sometime in March or June.

Not sure where you are getting the idea that there will be big movement next March or June. It is a very well known fact that the US government has a cap on the number of visas that can be assigned to those from one country. The number for the entire US is just 140,000 per year per the employer-driven EB-3 category, and with a cap of less than 10,000 from your country. There are more than 100,000 waiting for the green card, and more get added each and every week. Does not matter what opens up, the fact is that there are many more than the number of visas that are currently available.

And the I-140 is not even under the retrogression to begin with, it does not start until approval is obtained on the I-140. And it is not the regular Labor Certificate that needs to be included, but still a verification about the job, and its posting, does. Average wait is six weeks to get that done before an attorney can even consider submitting the petition in the first place, there still are requirements that need to be met. Remember that the Schedule A is no longer in existance, and the nurses are under the same requirements as those that are under the broader EB-3 category.

I agree with you that the DOS still do not have all the data they need because they are not even through w/ collating and giving the receipts from the applications in July and August of this year, however, there really is no definite time-frame on when things will improve and who exactly will benefit from it, if ever.

One thing is for sure, though. Those who applied for AOS in July and August will get their green cards in a long, long time. Much longer than usual. Processing for EAD will also take much longer than usual. This is so because USCIS isn't even through giving receipts to those who filed their I-140s and I-485s in July and August.

The last batch that did AOS were only able to get their green cards roughly 8-12 ++ mos. after it was filed and this was by the skin of their teeth.

USCIS already have an initial report saying that there was about 300,000 that filed for AOS for the month of July. No reports for August, so far but if we interpolate, we can say that there might be another 150,000 AOS applications or so from Aug. 1 until the 17th (deadline for filing AOS). That will be a total of 450,000 or so AOS applications and there is only an annual 140,000 visa cap. If there would be no special legislation to fix these, it may take the AOS applicants at least 3 years to be able to get their green cards. All of a sudden the line for AOS just got longer and there is no guarantee that AOS can be done again in the near future because of the sudden backlog that was created from the surge.

And what Lawrence posted just restates what I have been stating for sometime:

Graduating with a degree from the US in nursing no longer guarantees that you will be able to remain in the US after your OPT expires. And those that were planning to go the AOS route via the tourist visa are 100% out of luck. There just are no visas available, and we do not plan to see the AOS open up for sometime.

Green cards are just now trickling out for those that got thru before the retrogression started last October, it will be a lengthy time before those that got in during this open window get a green card. But as long as they get the EAD, that can be renewed.

The US only has 140,000 visas per year available for those under the EB-3 category. They accepted more petitions in a few weeks to go for more than two years, but we still do not know how many of those will actually be approved. They are expected to be very stringent with all requirements, especially of residency and having a completed file submitted in the first place. Meaning that the VSC needed to be included. They stated right from the beginning that they would not accept files that were not completed, they were not going to spend the time trying to get the needed information, they were just going to return them or deny them.
