NVC Revised Visa Bulletin, What does it mean

Can someone explain this...

UPDATE ON JULY VISA AVAILABILITY
The sudden backlog reduction efforts by Citizenship and Immigration Services Offices during the past month have resulted in the use of almost 60,000 Employment numbers. As a result of this unexpected action it has been necessary to make immediate adjustments to several previously announced cut-off dates. All Citizenship and Immigration Services Offices have been notified of the following:
Effective Monday July 2, 2007 there will be no further authorizations inresponse to requests for Employment-based preference cases. All numbers available to these categories under the FY-2007 annual numerical limitation have been made available.
Employment preference numbers will once again be available to these chargeability areas beginning October 1, 2007, under the FY-2008 annual numerical limitation.

this means that there is no visa available for fiscal year 2007. visa will be available again in 0ct.01 under fiscal year 2008. no petitions will be approve and we have to wait for visa availability again.

It can mean no adjusment of status petitions will be accepted at. All visa preference numbers will be posted only on mid september. Bad news to all, not only nurses.

About AMERICAN IMMIGRATION LAW FOUNDATION's lawsuit

"AILF is considering filing a lawsuit in federal district court against the USCIS over its rejection of otherwise properly filed adjustment of status applications for the alleged reason that a visa was not available,........

We believe USCIS violated the law when it failed to apply the visa availability dates listed in the Visa Bulletin, as required by a federal regulation, and instead rejected properly filed adjustment applications............we will challenge the rejection of adjustment of status applications on this basis. We will ask the court to order USCIS to accept the rejected adjustment applications and treat them as being filed as of the date they originally would have been filed had USCIS not rejected them."

Those with H-1B's were at least still able to file but not nurses since they don't qualify for an H1B. But...they won't necessarily get any visa numbers either that is correct, but those of us trying to do AOS from within the US can't even get in the que as that would mean giving up our current visa status and in the end leaving the country. Well hopefully things WILL be current in October but the uncertainty is killing us. I would have rather not had my hopes raised at all than to be let down at the last minute. And this does mean than when we do file, the cost for the fees will be double not just to my family but also to the hospital petitioning me which concerns me that they may not proceed. Hopefully not but who knows.

it means, we have ample time to prepare all our documents...

it means , we have enough time to plan our way forward....

it means, we cannot trust the visa bulletins anymore....

We have seen a fair number of nurses from around the world get interviews for this month. Those interviews will continue on as they have the visa number allocated for them and their dependents. That is not going to change.

And I had predicted in the past that there would not be any new visas available for anyone before the fall. What is being used right now are just recapped visas and was done to clear up some of the petitions that have been pending for sometime. This was never to change things for nurses in the first place, the retrogression is still in place.

suzanne says getting to the us is very difficult. waiting is part of it, waiting your turn since there are many ahead of you in the line. that's the truth. nothing can be done to change that. the nvc bulletin will come out whether we like it or not. we have no business trusting them or not. it is just the way it is, like a zen thing. no amount of whining or complaining or speculating can alter the bulletin. it's time to get back to the loop of preparing all that stuff again, to be fedexed again, to wait again. that's the way of things. everybody has to accept that. suzanne says the purpose of being a nurse is to be a very good nurse, not to get a greencard. a greencard is probably a side effect of being an excellent nurse. there are too many nurses applying for the us, that's partly why this is happening. that's mostly all there is to it.

and trust suzanne4, she's got the experience and the right information.

If you have not had the I-140 submitted yet, and gotten approval on it; then you are not even affected by this retrogression. This is the time to get petitions submitted for the first step, things are just going to get harder and more difficult with the wait, not easier as time goes on. The I-140 has never been under retrogression at anytime, whether or not your employer wants to spend the funds to get it submitted and the associated costs with it is something else altogether. But USCIS has not closed their doors for the I-140.

There is still a retrogression for nurses, so there is not any reason not to be trustful of the Visa Bulletin in the first place. They stated that they were just using recapped visas, and nothing more. And that is what they have done. Some attorneys made it look like there was more to it, and there was not.

I disagree, the visa bulletin is the only information we rely on. So if they change it even before it takes effect is a reason to doubt it. I think this is a political move to force congress to act on the CIR.

Very true...for that reason, my lawyer is filing my I-140 this coming August....getting a visa is another story....I have no problem waiting actually...I am still enjoying my life....it's summer time, you know...

regarding trusting the Visa Bulletin or not....it's up to us individually....but with the recent events, I would look at it but wouldn't trust it.....it will always have a shade of doubt in my eyes....

Why has your I-140 not been filed until now? And there is nothing that the Visa Bulletin was ever hiding. It explicitly stated that it was using recapped visas only, never said anything else.

And nothing has even been lifted from the RN retrogression in the first place.

If you do not like how our government does things, you are free to go to another place. For those of you that are not even here, and are busy complaining, there is absolutely no reason for you to be doing so. You have nothing to complain about. You will be coming to this country as a guest, and will be that for a period of about five years. If you do not want to do that, don't.
