being investigated for diversion

Nurses Recovery

I was recently terminated from my job due to suspicion of diversion. I refused to take a drug test and was terminated. I just got a letter from the Florida board of nursing stating they are investigating. Can they take away my license because of this? I was not impaired I was flagged by the pharmacy due to high amounts of narcotics being given

Call your . If you don't have malpractice insurance, get a lawyer.

Side note/question. If you weren't impaired & don't do drugs, why didn't you do the drug test?

I have the same question. Usually when hired, they will tell you that there are random drug screens. If the suspicion is there for whatever reason they can test you. If there is nothing to worry about, don't let your pride get in the way! Take the test and clear your name. That is obviously too late now, but yes, they can revoke your license if they have reasonable information leading to it.

Good luck!

Refusing is pretty much an admission to guilt.

Time to lawyer up.

*If* you don't lose your license they will probably add stipulations. I would visit the Nurses/Recovery forum.

Well since you were in a monitoring program I have a feeling you will lose your license.

May I ask why you refused the tox screen?

I also would like to know why, if you were clean, you would refuse a drug screen, it's a fast easy and immediate way to allay suspicion. It's not absolute proof of sobriety but it's generally assumed that if you refuse you are admitting to being dirty. I would hire a lawyer and don't talk to anyone about this without legal advice.

If it were me being accused and I had nothing to hide, (which I would not)---- I would demand a urine drug screen to clear my name.

Something ain't right here. I agree with the others; contact your malpractice insurer and get a lawyer. Say nothing more here.
