Hey guys!! I'm 20 years old. I came from Spain 5 years ago and I overstayed my visa. At that time, I could not fix my immigration situation in any way. I am going to graduate from the RN program at my school in December. After that, I really have no idea what to do about my legal status. Some people say I could fix my status if I find an employer and some people say that being illegal there is no way to change my status. Does somebody is in the same situation or knows somebody who has change from illegal to legal? Any advice? I have paid my tax and never ask for anything to the goverment...

One of our friends married a Canadian woman and it took forever for her to get a work visa. It took even longer to get citizenship.

I definitely agree with the others who recommend you see an immigration attorney. I would do so sooner rather than later.

Good luck.

DutchGirl - Those statistics only point toward a very very small aspect of illegal immigration. In fact, they benefit the U.S. in ways most people don't see: -Increasing the U.S.'s GDP -Help raise global productivity (by working in sectors that employ illegal immigrants for a meager wage but yet those sectors revenue a great deal of $$ because of it), -Increasing supply of labor, -Increase revenue for our economy (illegal immigrants purchase all of the ammentities you and I do), -Working in low-skilled sectors that have a small labor force population, and the list goes on and on.

On the flip side, there is a great deal of negatives associated with illegal immigration (in terms of our economy and the countries they are emigrating from).

But the overall idea is that illegal immigrants actually significantly help our economy (I think the number is among the lines of an increased .2 % increase in U.S. economy (0.2% seems very little, but when you are speaking in terms of billions and trillions of dollars, it makes a big difference.)

I recommend people take an immigrant economics class in their spare time.. it was actually a very interesting class. :)

You need legal advise not nursing advise but as far as claiming to be a victim don't even go there. Is every one who does something illegal a victim? I'm sure every one in jail could make that argument. I'll tell you when I was 19 seven months pregnant I got a repair and report ticket a tail light was out on my car. I was very busy in school pregnant and didn't go back to have it checked. I thought it wasn't a big deal. the police got me out of bed a 12:30 am and threw me in jail and personaly I think a tail light is not as big of a deal as being here illegally especially considering the current threats of terorisim. I'm not suggesting you are a terrorist but illegals could be!

Marry an American citizen and then apply for residency.QUOTE]

Doesn't work that way anymore. Immigration laws have changed post 9/11. I have a very good friend who is married to an illegal immigrant from Mexico - she is a U.S. citizen but her husband is not. He does not receive special treatment for marrying a U.S. citizen -- in fact he is going back to Mexico in August to apply for citizenship in the U.S.

This is not entirely true...your close friend is send back home to Mexico because he came here illigally right, meaning jumping through the river, crossing the border illgally without no visa, the op stated that she came on tourist visa..her only mistake or circumstance was she overstayed the visa...but orignally she came here ligally, there is HUGE difference..people who come here ILLIGALLY like your friend from Mexico are different type of cases. Daytonite was right the op has the right to marry a american and she dont have to go back to Spain to wait for the papers, all she has to do is pay is 1000$ fine for overstaying her visa, trust me had known people who did this...good luck.

Illegals are allowed to get a tax number so that they can pay taxes as an illegal immigrant?? What is wrong with this picture?

They may be paying taxes but they are costing us more than they are paying in.

On average, illegal households pay more than $4,200 a year in all forms of federal taxes. Unfortunately, they impose costs of $6,950 per household.

You dont have to be so harsh to the op, its not his fault that he came here when he was young, I assume with his quardians, give him break...he is not criminal, why you call all the immigrants criminals...its very offensive...

He does not receive special treatment for marrying a U.S. citizen -- in fact he is going back to Mexico in August to apply for citizenship in the U.S.

Yah, well in a way that is special treatment, 'cause he's gonna get to stay. All the info that's needed is on the INS site, the OP can see if he's cool. Plus if some new law goes into effect maybe he could do that, too.

:nono: So not cool of all you people who post negatively against this girl. She has gone to school and worked hard to make something positive of herself ..........and has almost finished her Nursing degree. For God's sake, give the poor girl a break!!!!

;) I commend you, and I cant imagine how frustrating and difficult it must be in your current situation. You have come here seeking advice, not hatred!!

Anyway, I was thinking that perhaps you could try and find a hospital to sponsor you. I think you would first have to take the state boards, pass them, then you would have to try and find a hospital to sponsor you before you would be able to obtain a license. They are crying out for nurses in this country!!! I know somebody who did it that way. She was a friend of my sisters so Im not sure of the exact situation.

I would talk to someone at the school in the Nursing dept. and see if they know anything. Otherwise, definitely try and find a good immigration lawyer!! I wish you the best of luck..........and congratulations on almost finishing your degree!!! You should be proud of yourself. :trout:

Illegals' wages leave the country. Wages in many sectors have plummeted, hurting American workers in those industries. And illegals use up public assistance intended for citizens. Personally I like my street people patients. I like it that they can get help. I don't like it that my tax money is getting hijacked on its way to helping these forgotten Americans, many of whom are veterans, many of whom are mentally ill and simply incapable of balancing a checkbook and paying bills on time. Hiring illegals is no economic advantage for our country or for our people, though yes, it's a huge advantage for exploitive business owners.

i have to respectfully disagree. i see patients come into the hospital, hard-working "americans" with no health insurance who have to sign paper after paper promising to pay every last dime of their hospital bill.

i see illegal immigrants come into the hospital, have surgery, or whatever and we are not even allowed to bill them for their hospital stay. the state does not reimburse.

who do you think ends up paying for their bill?

their children do not speak english. they get a free translator in our public schools. they don't have lunch money so they get their lunches free.

who do you think ends up paying the bill?

the japanese, who live in my town, who are here legally on work visa's have to pay for their children to attend a special japanese school because their children don't speak english.

low wages, yes they work for low wages, yes they pick our fruits and vegatables, they don't have enough education to do anthing else. you think if we eliminate them who is going to do the picking? you're going to have to hire americans to pick them and pay them alot more and the price of fruits and vegetables will go up? besides you can't get americans to do that back breaking work in the hot sun.

this is just more of the tired old whine...who's gonna pick our fruit? well, gee folks in the last century we got along fine without an overabundance of illegal immigrants. so why the argument now? it's just an excuse to get away with getting one's illegal foot in the door of the usa.

twelve americans are murdered every day by illegal immigrants, according to statistics released by rep. steve king, r-iowa. that translates to 4,380 americans murdered annually by illegal immigrants. that's 21,900 since sept. 11, 2001. http://wnd.com/news/article.asp?article_id=53103

i have personally witnessed an auto accident where a newly retired married couple were on the way to see their first great grandchild when they were hit and killed by an illegal immigrant who was driving on the wrong side of the road, drunk and without a drivers license.

i say the usa needs to put a stop to this. until we can feed, employ and have health care available for our own citizens. until then i say, no more free health care, no more free food stamps, no more free public education for these criminals who blatently ignore our immigration laws. they are not interested in becoming american's but rather in using and abusing our economic system. those who further break our laws once here are spending time in our jails. they are represented by legal counsel at no cost. we feed them in jail, we cloth them, we keep them warm and dry, we take care of their health needs.

who pays the bill for this?

they come here illegally, have children and these children automatically become american citizens with all the priviledges and the parents are now automatically able to claim residence because they have an american citizen to support. murders are not allowed to profit from a book written about their crime. the parents are here illegally, this is a crime and they are profiting from it royally. free education, free healthcare compliments of uncle sam.

who pays the bill for for all of this?

we "all" pay the bill for illegal immigrants. i would rather pay more for my fruits and vegetables and i quite assuredly say that the rise in the price of produce would be a mere pitence compared to what we are really paying to have these illegals pick them for us.

how do you figure that you ae a 'victim of the system'? what did you think was going to happen when you stated school?

is there a certain number of legal emigates allowed into the us from spain, how do you go about geting on the list..if yo go home and work a couple of years i am sure that you could get high on list due to having skills that are in short supply

The OP came to our country as a child. A child brought here by her parents. She is not taking advantage of other Americans. She got into nursing school, that seat should have gone to a citizen but which school official checked to see that she was an American? She has paid for her education and not by asking for handouts, not by having a child to stay here or by marrying an American citizen.

I came here as a child, brought here by my parents, my father had a green card because men in his profession were needed here to work. As a child I did not know any difference between belonging to Holland or America. When I became an American citizen I didn't even know what that meant. It was not until after I was married that I truly realized what it meant to immigrate here and become an American citizen with all of it's priviledges. I am proud of my Dutch heritage but I am more proud to be an American citizen and thankful that my parents brought me here and that my children were born here.

I think the only course of action for the OP is to contact an immigration attorney and do exactly what he/she deems necessary. That may mean returning to Europe temporarily, it may mean she can stay because her profession is also needed here but the attorney has got to be the ultimate judge. I would hate to think the school would not grant a diploma and probably could withold it under the circumstances. Therefore I would NOT TALK to anyone at the school or any employee about sponsorship. An attorney is going to have to be the only judge and jury for now. She has asked for our help, I don't believe she has purposely broken any laws or abused our country and we shouldn't judge her so horificely.
