H1-B Visa Available for Nurses?

Recently, I had a very interesting interview from an employer who intends to hire nurses for US on an H1-B Petition? Last time I checked, Nurses were not included as candidates for Working Visa. Did I missed out on some news?

Nurses from the PI are apparently getting through this route from many anecdotal news. This is the only way left with the EB3 route completely shut down in the foreseeable future. Good luck to all who are taking this risky road as well as those using tourist visas as loopholes to sneak in ahead of the line.

How is a work visa a "risky road"? It's a legitimate method of work for specialist professionals who do not want to immigrate permanently.

You can hardly equate work visas with people abusing tourist visas.

I have a multiple tourist visa but I still want to work legally. What are needed to prove that I am an ICU nurse so I can pass the requirements or H1B visa, I think it's non capped.

Specialty certification such as CCRN, or documented evidence of work in ICU.

Not all hospitals are uncapped you need to check.

Capped exempt usually are institutions of higher education or a related or affiliated non-profit entities, or at non-profit research organizations or governmental research organizations

A little off-topic, but I read the memo (dated 2002) and noted that it specifies, toward the end, that North Dakota is an exception (to the general rule that general RNs don't qualify for an H1B) because North Dakota does require a BSN for licensure in the state. North Dakota did pass legislation that mandated the BSN as minimum requirement for RN licensure, but rescinded that requirement a few years later -- at this point, ND licenses associate's degree grads, same as everyone else, so that exception doesn't really apply any more.

Hi,

Is it possible to do both application for H1-b and I-140, and just wait what will be approved faster? Iam a Philippine Registered Nurse,Passed Nclex and Ielts and in the process of applying for Visa Screen Certificate. I can look for employers here in California for employment petitions because at present I'm here in California using visitors visa.I understand though that there's no chance of AOS and I plan to do consular processing by the time I will return to the Philippines.

hi dranreb,

im on the same situation right now, but this was 2 years ago for you. so i just wonder what now happened to your application, im curious u know im on the same situation like you..thanks!

I have a question that I am a F1 student and my wife is F2 dependent. She want to do a nursing degree on F1 visa from US institutution.

I have questions regarding that

1. She wants to work in US after completion of studies on H1b visa. Does foreign students that are trained in US get H1 visa after their completion?

2. Which degree she should prefer to study associate(easier to get and less expensive) or accelerated BSN (harder to get and more expensive)as she already have bachelors from India so she is thinking more about that.

can she get H1b visa if she does associate degree nursing and become RN in us?

3. What other requirements (such as visa screen and CGFNS) she need to fulfil before she can get an H1b visa?

4. Does the green card application process is same like other categories of occupations as that of nurses or it is different?

Plz reply me asap with this info. as she is stuck to choose between associate degree and accelerated BSN program.

Thanks

"the purpose of this memorandum is to provide field offices with guidance on

adjudication of h-1b petitions when the beneficiary is a registered nurse (rn). this

memorandum clarifies that while typical rns generally do not meet the requirements for h-1b

classification, aliens in certain specialized rn occupations are more likely than typical rns to be

eligible for h-1b status."

your wife should save her money unless she wishes to practice nursing in india. sorry, no easy way to beat retrogression.
