H1-B Visa Available for Nurses?

Recently, I had a very interesting interview from an employer who intends to hire nurses for US on an H1-B Petition? Last time I checked, Nurses were not included as candidates for Working Visa. Did I missed out on some news?

And be aware that what happened a year ago is completely a different thing now in the world of immigration in the US. They are also going over everything with a fine tooth comb and if the nurse did not have the VSC in hand when the petitions were submitted this summer, they will get denied per the rules that the State Dept put out when there were forced to accept petitions when there were no visas available.

And we are seeing some nurse that got thru with their petitions a year ago being denied the I-140 now and being told that they will need to leave the US in a very short time, and this is not subject to any appeal as there was never a green card issued to them.

When under the AOS processing, most are in a limbo state to begin with.

The issue is plain and simple, there just are no visas at this time and hospitals are unable to employ under the H1-B category. So trying to get around it will just bite someone on the backside. We keep getting e-mails from posters here with all sorts of scams that they have received promising a quick visa for the US, that just does not exist. Anytime something sounds too good to be true, it always has been.

It is your choice as to what to do, but when I see others taking cuts in line because they think that they are better than the others that have been waiting, it gets me extremely upset as well as the others here, even that someone would consider it. There are no visas and therefore no way to adjust a status, even with passing the NCLEX and finding an employer. They do not grant visas, even though we have seen some that have posted that they can do that, it is just not going to happen.

Visas are only issued by the US State Dept which is over the US Immigration Service. No other entity can create a visa for someone.

Please help to enlighten me as I'm quite confused right now. I know from all the information you've given that there's no way H1B can be given to a nurse but I got a call from my agency today asking me if I want to go to US with H1B visa as my employer, UPHS, is willing to pay for that despite the fact that they've already spent for my immigrant application. I was supposed to have gotten my immigrant visa last year but I lacked one document (NBI) from Philippines, when i went for my interview and it was already too late when I sent it to the US embassy as all the visas have already been used up.

My agency has also forwarded to me all the correspondence from UPHS answering all questions about them sponsoring H1B visas for us nurses. What do you think about this? I don't want to go to US illegally. Is this legal? But University of Penn Health System is such a big institution to be using dodgy means to bring nurses to their hospitals. I'm so confused. Please reply. I'm here in Uk right now and I would also like to know what will going to happen to my immigrant apllication If I can go to US thru H1B.

I was recently hired as nurse under H1B visa, they know I have an approved EB3 with 2008 PD. Are thre nurses with approved H1B visa at this time. My worry is, can I finish the 3 year contract with them before my I 140 become current.The liability of both contract is terrifyng if I can't honor them. Thank you in advance for your advice.

The problem may be that your H1b visa expires and you are still waiting for PD to move. Remember many are waiting since 2006 for a visa and they are in front of you in the queue. Are you prepared that you may have to leave the US if your H1b visa is up or cancelled?

Thank you for your advice. The company is Cambridge Healthcare, they are hiring nurses under H1B. Do you think it is possible to have an approved H1B visa, I am an ICU nurse for 2 years and have CGFNS,IELTS,NCLEX and Visa Screen.It is okay with me that I will return after the 3 year contract, my worry is while under H1B company my PD become current and I have to serve my contract with the other agency which would mean have to pay the penalty .Although, basing from the visa bulletin it is not really possible that EB3 would become current, I need advises if I'm making the right move by signing the contract under H1b company. Thanks again!!!

I can't advise you on what to do. Retrogression dates I personally feel will not improve quickly but who knows what will happen. You have to make this decision yourself but at least you are aware on any cancellation fees etc

I think you have up to 6 or 7 years on a H1B, so hopefully it won't take that long to get an immigrant visa.

How long do you have to work on the H1B before you don't have to pay the cancellation fee?

Nurses from the PI are apparently getting through this route from many anecdotal news. This is the only way left with the EB3 route completely shut down in the foreseeable future. Good luck to all who are taking this risky road as well as those using tourist visas as loopholes to sneak in ahead of the line.

Depends on whether the H1b is capped or not. If not then I think the closing date is looming (if not already passed) if you haven't already got a employer. If not capped then filing is 1st April for October start if you are lucky to get one. If non capped I think you are looking at approx 6 months for the visa
