So, I posted several months ago.
I self reported a positive drug screen 5 months ago. I don't do drugs, it wasn't an intentional thing. Let's just leave it at that.
BON is finally looking at my case. I got a phone call from IPN that the investigator on my case from the BON contacted IPN for an "emergency referral". IPN lady said I had 24 hours to agree to get an evaluation and voluntarily withdraw my license. The ironic thing is I already got an evaluation per my lawyer, who is approved, but since it was not "IPN facilitated" I cannot use it with IPN. ?I knew this would probably happen but my lawyer was hoping to present it to the BON and not deal with IPN.
My evaluation I got on my own did NOT suggest monitoring which is amazing! So I plan on sending that to the new, IPN owned, evaluator. I'm sure he is in their pocket and financially driven to say that I'll need monitoring. I'm mentally prepared for that part.
My concern is I've received nothing from the DOH/BON. My lawyer says I have two choices. Play the IPN game, or try to deal with the BON, but risk a suspension on my license while they "investigate", and a public complaint on my license.
I can see why IPN backs you into a corner and makes it seem that the only way is through them, by their arbitrary rules.
I'm waiting to hear back from IPN. I knew I'd get sucked into this, but a positive evaluation made me think for one moment I'd prevail.

Is it hard finding work With the mark on your license? And is it public? If so what does the status say ? Is this something EVERYBODY can see if they look up your license?
If that's what is important to you then that's all that matters. Having a "mark" on your license all depends on the employer, what the mark is for, etc. I used to do recruiting and if you had a mark, we wouldn't use you regardless of why because we have to disclose that to the employer and it isn't worth the hassle unfortunately. I have many amazing and safe nurse friends with marks on their license that have great jobs, just had to jump through some hoops. Just have to weigh the positives, negatives of the situation and make an educated and informed decision. Unfortunately I know from experience.
Unfortunately it has with a few hospitals and for travel nursing. On mine it doesn't State what happened its just the mark. My lawyer said just don't tell them..I'm like ya right I would not hire someone who wasn't honest. It is supposed to come off after 10 years or so I have read if unfounded which mine was. But I don't know that yet I'm at a 8 year mark. I am currently working at the hospital this all happened at . If nothing else after my fight they changed the policy at the hospital. If your injured which I was by a patient the first thing they used to do was drug test you. Now they do not. The whole mess is just that a mess..which is why I vow after I retire to try and change the system...I got the policy changed slightly at my hospital so it's a start. If you can fight it do it !!.but if you can't that's understandable. It's exhausting and expensive.
Your right..the recruiter I worked with regarding travel said. If you have a mark they will bypass you if they are reputable becuase they can ..which is understandable. I just hope someday this all changes ...The job I have now is great and I make great money. I'll stay here till I retirein 5 years becuase I honestly don't want to go through the hassle...
I would like advice , I am in a somewhat similar situation in Florida. I was given a drug test because two Marinol capsules were undocumented, unwasted, and unreturned. I forgot to waste one capsule , the other one must have been a scanning error. I did not take these pills , and I am not impaired. I got bonuses for 100% scanning accuracy for 2 months. I failed the drug test because I did smoke pot on vacation in Mexico (where it is not illegal) at a friends wedding the week before . I got a lawyer who wrote my resignation letter . Since I did not do anything illegal and I am not impaired the lawyer wrote that I do not have to be reported to the IPN. The hospital HR replied that I was terminated but did not mention reporting me. I asked my lawyer what next and the lawyer said we wait. This was a month ago and I have not heard anything from the BON nor DOH. How do I know if the hospital reported me or not ? I asked my lawyer , but she replied that I need to pay the next $3000 of the retaining fee before she could reply . I am currently looking for a new job, will I have to quit if I get investigated ?
Hey, find another job and just wait. Your lawyer sounds like a scammer if she told you that because she won't even know that until you get a letter or call from DOH so be careful with that. I'm in Florida as well. Paid $6000 to my lawyer so far but I'm still under investigation. Failed pre employment drug screen for THC. My lawyer was upfront about the process. Telling you to pay $3000 of the remaining retainer for he/she to answer a question she don't have access to is questionable
And no you don't have to quit the new job if you're getting investigated. Everything is confidential until they make a decision. I'm going on 3 months at my new job. Starting a new one ( 2nd job ) on Monday
Get another job asap. Show you have a god track record with your new job. It takes months for the BON to launch an investigation. Don't smoke any weed even if on vacation where it's legal. They could test your hair and that can show 3 months worth of drugs. Don't pay that lawyer. I hired Chapman law who also is FL. (I'm in MI) they didn't do anything to help but took 3k then I fired them and represented myself and had my charges dropped
