I am supposed to enter my senior year in a BSN program by August, i already completed 3 semesters in the program. I just found out my nursing program sent my a dismissal letter for what they tagged "unprofessional" behavior. These behavior includes calling my teacher less than one hour to a lab class to get permission to be absent due to sick health, waking up late due to a sickness and could not attend a 6:30am clinical which i already made up, not being able to review my nursing exam afterwards because i wad having serious anxiety attack, etc. The point is that look for every opportunity yo write me up because I'm one if their best and the only black.
They already told me at the last disciplinary meeting that i have one chance before being kicked out and i have not used that last chance and they sent me a letter of dismissal when I'm already away for break.
My questions:
1) Can i appeal this successfully?
2) Can another school accept me if i choose to transfer?
3) Is it advisable to make this a court case and will it have any effect on finding a job here afterwards?
Note: I am an international student on an F1 visa for now.

Stop playing the race card. To me it shows a lack of taking responsibility for your actions and blaming your failures on someone else.

Sorry, you just lost all credibility with the race card :/
Court case will likely be costly and go nowhere - if they're writing you up for unprofessional behavior then really think why they are writing you up. I can almost guarantee it's not because of your race.
Calling out with less than 1hr to lab is a no-go; usually the minimum is 2hrs (this includes most places of employment).
If you were one of their best, then surely they'd want to see you succeed. A success looks great for them. The fact that this seems to be ongoing (mention of prior disciplinary meetings) really screams that this is more of a you issue, and not a them.
I appreciate your opinion but it is not really what i meant. I have been marginalized in so many things. I was actually denied acceptance even when i submitted all requirements and was among the top 10 applicants. They claimed one of my transcripts was missing but when i reminded the teacher i gave it to that she was the one i gave it to and she asked me not to submit again in future, she bowed her head in shame, got up and went to grab my file that has always been with them in the office and the transcript was in there. After i received the acceptance letter, the real war started and i have always been picked on. I'm not here to beg for pity but to seek a way forward.

If there are policies in place which support the school's actions, you do not have a case. And to your other question, you cannot transfer nursing courses between schools. You will be starting again IF you find a school that will accept you with multiple disciplinary actions on your academic record.
Multiple disciplinary hearings indicate that there are two sides to this story, and we only have one.
I mentioned that I'm the only black not so much in the negative sense. I actually started calling more than 2 hours prior but i forgot to send an email for documentation purpose. I only reported to school in mufti less than one hour to the lab when the teacher refused picking my call. I went to see her in person to explain and get permission yet i was written up.

Everything you listed that you had done is considered unprofessional behavior, and no nursing school would have put up with it. I'm sorry this happened to you, but I don't think pulling the race card is appropriate in this case.

When a person knows that they are under the microscope, or even feels there may be a reason for that to be the case, then they take all measures available to them to cover their back on every action with the opposing side. Instead of waiting to the last minute to call, call earlier than that, way earlier. Email, and if need be, snail mail evidence for everything, a peer to act as a witness, copies of papers, dates and times annotated, etc. If you don't watch out for your own interests, you certainly can't expect the opposing side to drop the ball or to be considerate of you. After all, in this case, they are the opposing side. And lest we forget, the best way to avoid problems is to follow the rules and don't get on the defensive side of the fence for any issue to begin with. Those who got to clinical and on time, did not have to worry about any of this.

It seems from your post that you were dismissed from the program for absences/latenesses in your classes, labs, and clinical. Some colleges may consider that unprofessional behavior even if you have legitimate excuses. If you kept missing shifts at work and gave little notice (less than 2 hours) it would also be considered unprofessional and could be a fireable offense in the worst case scenario.
Of course, it is impossible to know the whole story just from a couple of paragraphs and I could have misunderstood the reasoning behind your dismissal. If this is an attendance issue though then it could be grounds for being kicked out.
You could try to appeal and ask for another chance. You said you hadn't used up your last chance but without a way to prove this to the college board it's your word against theirs.
If you can't get back in you could apply to another school and see if they will accept you. I would advise refraining saying anything derogatory about your previous college if you are asked why you leave. That leaves a bad impression at interviews.

You have one too many absences and I think that's the real problem. Even if they were being racist, the fact that you don't show up to things sort of works against you. Remember that you're going into a profession that requires your presence. This isn't one of those jobs where you can work from home. If you can't commit to showing up, how do you think you'll manage in the real world of nursing.
Call around and see if you can transfer to another program with the credits you have.
As a supervisor, I would be separating you from joining the labor population for this reason alone. There are few things worse than an employee who doesn't show up for work and who expects their excuses to act in their place. Excuses don't take care of patients. Hopefully, you will learn this lesson now.
