Did anybody get denied?

Published

Does anybody know of anyone who did not get their green card or got denied ? I'm talking about nurses only and exclude those cases, of course, who are not qualified or commited a murder:)

i got denied.

sadly, this is true after waiting for almost a year for an answer. my employer just informed me this afternoon. actually, there were 40 of us.

the reason for some of the applicants that were denied was because they did not have the cgfns certificate. unfortunately for me, there were no real reason because my documents are already complete. i have my visa screen, cgfns certificate and all the other possible documents ever conceivable asked by my ins.

i was told by my employer that they will have to refile the whole thing and sign me up to another one of their facilities in new york. in addition, i was told that my job description was wrong for the facility that i was assigned to. i don't actually don't know what to do anymore. i guess this is me telling everyone that bad luck has bestowed its little dirty hands on my papers.

i need advice on this matter. should i refile with the same employer with one of their other facilities? is it wise to do this since i don't know what the real reason behind the rejection? if i refile, it may prove futile for i may get denied again.

my employer encountered other problems like this... some of them even nclex passers and told me that the second time they applied, they got approved.

anyone got any better idea?!!! right now i am confused and frustrated. i mean i haven't been to the u.s. and i haven't tried for any tourist visa or whatever... so my employer could be right. funny thing is my case status has not changed for the last two months still the same.

"application type: i140, immigrant petition for alien worker

current status:

on february 16, 2006, we received your response to our request for evidence or information. it is taking between 90 and 485 days for us to process this kind of case. however because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. you will receive a written decision on this case."

please help.. i am desperate.... i am also worried about the depletion of the visa numbers available.

by the way, even my employers were shocked and apalled by this development. any comment or suggestions would be welcomed by me.

thank you in advance.:o

Specializes in Nephro, ICU, LTC and counting.

i got i-140 approval notice yesterday evening. :lol2:my application was sent to vermont center on jan 25, 2006. i got ead approval notice day before yesterday.

just a note to all fellow nurses who are applying for adjustment of status. ---send your application asap. one day makes a lot of difference. ead approval doesn't require medicals. i haven't sent mine yet but got ead.

ead does require medicals, some how you got by without it, but they are required.

who is your employer, first of all? sounds like the attorney that they are using doesn't know what they are doing. and that the agency gave them the wrong information.

my suggestion, run as fast as you can from them. if this happened to 40 nurses of theirs, they re inept. and consider it an omen, run as fast as you can from them.

and for your "employer" to submit documents for someone that does not have proof of passing the cgfns exam, what were they thinking? they wasted everyone's time. hope that immigration puts them out of their misery and closes them down. they deserve it.

bebotwaiting,

Sorry to hear this!!:o

I don't think you need to apply with this agency/employer again.

Do it yourself with a different employer. And get a good attorney.

This way nobody will be able to take advantage of you, like these people did.

Are they going to at least refund your money???:angryfire
