California early termination of probation

Published

I was on probation with CA Board of Registered Nursing. I got released from probation 11 months early. In addition, I got accepted to the MSN-FNP program and will start in Fall 2021. Life is good! There is light at the end of the tunnel.

Hi! My 2 years is in April, and I'll be eligible to apply for early termination then. Would I be able to receive that copy as well?

 Thanks!

Hi! Apologies, but I haven't been active on here in awhile. Do you still need this?

When you were on probation were you allowed to work??
thank you

Yes, but your job has to be approved by the board before you can work. It also depends on what placed you on probation in the first place. Everyone's case is a bit different.

Hello Helen,
I surrendered my license after paying four different lawyers and spending over $40,000 on lawyers. What I learned is that some lawyers will give you hope just to make money, once the board decides that they don't want any settlement, most likely they will not change their mind even if you go the hearing. I surrendered my license for a year, and was allowed to apply for reinstatement after a year.  The paperwork took around a year and three months after I applied. I got my license back, but was placed on probation for three years. My case was not reletated to substance abuse. It was due to attempting fraud for lying on an application to the BRN.  From a lot of the cases I read if it was due to substance abuse if you surrender the process can take longer to reinstate the license, but every case is different. Make sure you find out if they have any programs for you before you surrender. Good luck.

Thank you for the information I appreciate it and yea I can't afford a lawyer even I wanted to. I have extremely bad credit. LOL can't get loans and I don't have family. It's just myself and SO. I know a lawyer will help. Thank you glad you were able to get yours back 🙂

Hello, I see you all are already on probation. I just got a call today but was told by the AG that I can not make a settlement due to my charges. Has anyone else had this situation? He stated that If I have any poof or evidence that I can submit it and we can go to trial if not he suggest that  I surrender. I am guilty of my charge. I will admit I was addicted to narcotics, and diverted them. I have since got into a MAT program,  will informing the board and showing them prescriptions make a difference? or should I do as the AG stated and just surrender. I am so scared to go to trial this is my first offense. But I don't know what exactly will happen if I do have a trail.

I was under probation for a DUI in Ca, nearly 7 years before entering nursing school. However, many of the nurses in my mandated RN Support group were there for diversion. Not a single person was successful in getting charges dropped. Those who tried, wasted thousands of dollars in lawyer fees only to be offered the SAME exact offer from the BRN. I highly recommend you do not spend the time or money going into litigation. Accept the offer, stay in compliance with the program, and hope for early termination if you can. I hope this information helps!

It will be challenging, but you can do it, and will come out a stronger individual and nurse because of it.

Thank you for the information 🙂 I can't afford a lawyer so definitely that's out for me. I missed my initial board hearing.. due to mail issues I the AG called me yesterday and stated if I did not want to surrender that I will have a hearing in Aug. I figured that would be when I can tell the board myself yes I have an issue. I'm aware and I want to get help. Vs just surrendering and never explaining myself

LMRN2003, would you need to submit new fingerprints when petitioning for early termination?

Nope.

I have recently been hired to work as a RN Case Manager for Hospice Home Health. The BRN approved it. Supervisiom includes daily in person check ins at the start of shift, supervisor accompanying me on a visit once every 2 weeks for the first 3 months (then frequency goes down to monthly), and daily phone calls to supervisor at least 2 hrs prior to the end of my shift. There are job options other than SNF but it truly depends on the RN's situation that led to probation, status in the program, etc. Just FYI. There is another Probationary RN at my work as well. I also know of two others who recently applied and were either not offered the position or not allowed to do the position, so it definitely varies.

Hi. I am on the same boat and I've been applying to different case manager roles. I am also worried about the BRN approving this work because it is a workers comp field case manager,do you know how the process will be with the supervision stipulation?

It depends on your probation stipulation, your monitor, and the NEC that is reviewing and either approving/disproving your job. Like I mentioned before, not everyone is allowed to do home health. As long as your order says you may work home health, it SHOULD be approved, and will likely be something similar to my supervision that I had (supervisor doing a ride along every two weeks, daily check ins at the beginning of my shift, phone call check in during the day, etc).

Has anyone been able to find a job in North Cali while being on probation? I need help. Tried dialysis and psy. Got rejected by all
