update 1:
on june 6 dos ammended their june visabulletin by adding a new category for nurses (schedule - a) and making it as 'current'. that means, all wait is over for nurses now and gates are re-opened officially on june 6th.

as the regular readers of allnurses.com know, this thread can be connsidered as the continuation of the thread "worst news for rns from india, phili..." (click here to view that thread : https://allnurses.com/forums/showthread.php?t=87149). worst news thread was started when darkness and gloom hit intl. nurse community when dos announced (dec 11 2004) the retrogression for nurse immigration from these 3 countries.

appropriations bill in to a law :biggringiand henceforth , at
this very moment (may 11 2005 8:30 pm cst), additional 50,000 visas are available:melody:
for nurses:nurse: and their families.

The retrogression is essentially still in place. None of us have any crystal balls as to who will be able to be included in that 50,000 number. Remember that it also includes physical therapists as well as family members of both.Please just sit tight............you also did not say where your petition is being filed. Right now California is essentially current, but as soon as all of these applications are put back into the quotient, the dates are definitely going to fall behind. It has taken on average at least two years in the past for the green card for California. We will have to wait and see how long that the delay will become since many applications have already been completed if the nurse was not from one of the PIC countries.

New Development in Manila Embassy!
Manila Embassy released today an announcement to inform everyone about the resuming the processing of EB3 categories who are affected by retrogression. They will resume late June of 2005. Please note that the National Visa Center (NVC) and the Embassy will schedule visa interviews for the additional applicants in order of priority date and documentary qualification. E3 applicants who will benefit from the legislation will be notified as soon as implementing guidelines are established and cases can be processed.
So the KEY WORDS here are priority date and documentary qualified. So even if you have an earlier PD but your documents were not stamped by NVC as qualified you have to wait in line.
It also answer our question why the delay??? They are still establishing implementing guidelines!
This is the first time a US gov web site discussed this topic and gave details!
So I guess, these are very good developments and these info came from US embassy Manila and not from any lawyer's prediction and gut feel!

Hello everybody! With regards to this issue, I would like to know if it's possible for me to receive my visa before September? I'm done with my Packet4 (medical & consul interview) last September 2004, it just happened that I pass my TSE October 2004 and my visa screen got delayed, I was able to submit it to the US Embassy Manila last February. Will I be able to receive my visa soon? Thanks in advance.

In order for you to know if your papers are documentarily qualified, you have to email the NVC at [email protected] , write your case number on the "subject" portion of your email letter. Also include your petitioner's name and the beneficiary's name before the introduction of your letter. This is the correct format when sending email to the NVC. They will reply within 2-3 days. Try it, I did it myself and they said that my name was listed under documentarily qualified applicants awaiting visa interview while the some of my friends were not given this kind of reply. my I140 got approved last aug 2004 but the lawyer only sent my packet 3 last may 3, 2005. am also wondering why the delay. maybe, like you said, NVC stop accepting application last Oct 2004.Your thoughts please

No need to worry. That 50,000 visas are for nurses and pts alone. According to refutable lawyers these visas are good for two to three years. Since your petition will be processed thought Vermont Service Center then you can get an approval with in a few months. Three to four months at most.

From the Dos website on their definition of Documentarily Qualified:
Documentarily Qualified: Refers to an immigrant visa applicant who has: 1) returned Form DS 2001 (from the Instruction Package) to visa-issuing post (or in some cases, to the National Visa Center), OR 2) informed post in another way that he/she has all the documents for his/her immigrant visa application, and the post has completed its clearance procedures.

Sorry, I forgot to mention that. Yes, that 50,000 visas are for nurses, pts and their dependents. But that is a lot of visas. Before, we used to compete with other EB3 applicants ( teachers, IT consultants, etc), not anymore.
