Dale,

Why is it that my friend already received letter from the NVC when in fact she did not have her D230 form yet. I really intend to include my daughter with my D230 form...thanks for the advice. Another thing would it be wise to have my NCLEX in hongkong while waiting for my visa turn?

Yani

Where the petition is submitted is dependent on where the employer is based, not where the nurse may be working........especially if going thru an agency and the agency is actual petitioner.

You can be petitioned by an agency out of New York or even Ohio, and that would be handled by Vermont.....even if you are going to be placed in California. :) Your green card processing time would be "Vermont" time and not "California" time.

california etc have caught up partly with vermont because of retrogression, because the pds are given importance ,dont leak out all the secrets suzzane all, will make a beeline for vermont, mine was throuh in faST time ,good day

Rossario

I think my documents were already sent by NVC for consulate processing.

Two weeks ago I called them to check my docs and they told me that they are waiting for the PD to be current. But now I check with them and they said that my case was completed last May 16, 2005 and wait for an advice within an 8 week period.

Does anyone have the same experience? For others comment.

Hi dhel:

I have reviewed your post and you said that your approval date is last august 2004. what is your priority date? if you got your approval last august 2004 why did it took too long for you?

Yani,

Once you have your I-140 approval, the USCIS will send the approved immigrant petition to NVC, if an immigrant visa is available or if your category is current, the NVC will send a barcode sheet to the applicant, which must then be returned to the NVC with the appropriate fees. Once payment has been received, NVC will now send form DS230 part 1 to the applicant for completion. Once that form has been returned to the NVC, the NVC will send form DS230 part 2 along with a list of documents that should be brought to the U.S. Embassy.

About your NCLEX, it is always good to be an R.N. when you get in the U.S. But taking NCLEX in HongKong is expensive. Aside from the expenses to fly there, hotel accom, getting to the test center, you have to pay pearson $200 plus $150 international testing fee, plus the nursing fee from the nursing board. If you got money to spare that would be good.

Another choice would be to apply for an interim permit, in which you will apply for NCLEX but you will be taking NCLEX in the U.S. An interim permit would let you work as a nurse but under a direct supervision of an R.N. while waiting for the results to come up.

Hope that helps...

dale

It is almost impossible to get a job as a foreign nurse with an interim permit in any reputable hospital. They just aren't going that route. They want to know that you have passed the exam before they will begin your orientation.

About the only place that you will find work with the interim permit is NY, but you can only get that after you show a passing score on CGFNS and an RN has signed to be responsible for you............and that is on the application for the permit.

Most agencies will pay for the NCLEX to be done before arrival in the US. They get the nurse working faster that way also.

dale

my I140 got approved last aug 2004 but the lawyer only sent my packet 3 last may 3, 2005. am also wondering why the delay. maybe, like you said, NVC stop accepting application last Oct 2004.

Your thoughts please

My I 140 petition got approved last August 2004 and I sent my DS 230 last OCtober 2004. The NVC completed processing my case last January 2005 and I am now currently waiting for the Visa to be current for the Packet IV to arrive coming from the US embassy. There must have been a huge delay on paper since you only received your DS230 just this may.

hi rep, am bianca from the Philippines. help me pls. My employer will file my I-140 application this June 2005. Does anyone knows if there is a possibity for me get included in the 50,000 EB-3 visa for nurses in the Philippines. How long is the processing time? Thanks.pls help

I agree with you. Myself, for example, will be bringing my wife and three children. That means 5 US visas. Multiply that, we expect around 10,000 to 15,000 foreign nurses will get their visas this year. If we assumed all these nurses have families.

Acccording to Mr. Shusterman, http://www.shusterman.com, by October 2005, when all the visas will be used , the retrogression will set in again.

The 50,000 additional is good news to all us whose Packet 3 are with the NVC for processing. But for those who are still starting the process, this means nothing to them. 2,000 visas cap per country will not help the Philippines, India and China unless the US congress and Senate will enact a law that will instruct BCIS to use unused EB3 visas from other countries and allocate them to the PIC countries every year.

Let us celebrate because this is good news and I know many of us whose ds-230 forms were submitted to the NVC along time ago will get our Packet 4 in a few more months. :)
