who among us here applied for the FY 2011 h1b visa and has been approved?

ok when you said about :

a bachelor's or higher degree (or its equivalent) is normally the minimum requirement for entry into the position;

I do have a bachelor's degree.. so i qualified for the minimum requirement.

they said 1 college year equal to 3 work experiences..

I am confused here since attorney said okay about that....

please, advise.

The issue is the embassy may ask what experience you have in being a supervisor and the employer needs to provide adequate proof that they can not employ a USC or PR for the job.

And with the unemployment situation in the US so poor, would sincerely doubt they will take foreign grad over USC for a nursing home position. We currently have RNs that work as CNAs in NH just to have a job.

I would certainly investigate these claims prior to giving them any money. The situation in the US is extremely bad for ALL NURSES.

I am debating between 2 jobs I have so far.. currently I am working in clinic and urgent care. but other job offer pays better but it is not really what I want to do and smaller than current job...

before I decide about that I want to make sure about experiences requirement.

it seems like once i get a job as a supervisor with BSN, as a paper work, there is no problem with that... i dont know... my doctor suggested me 2 laywers to ask...

The issue is not whether you have a BSN or not -- it's whether the position requires a BSN.

Sorry to say but it is very unlikely the USCIS will approve this kind of petition for the mentioned position.

All I can think of is the patients, nurse, no supervisors experience, no nursing home experience yet they have a nurse with a BSN. It makes me think this nursing home only wants a body to fill the position by a nurse who can't complain without fearing for their position. I hope people aren't paying the attorneys for finding the position and the attorney is skilled in obtaining visas for nurses which is very different then other professions.

The attorneys can say whatever they like. They are the ones who will make a profit out of this. The ultimate decision of whether this will be approved or not will depend on USCIS via the interview at the embassy. This case definitely raises a lot of red flags in terms of the need for a BSN-educated nurse in a supervisory role in a nursing facility - something that is not standard practice across the board. On top of that, the background nursing experience to justify the hiring of the particular candidate doesn't even match with the particular job opening.

okay thanks for all reply. well, then I will just work as RN but cant file for H1B visa.. which is fine,too.. first, I will try to get experiences in ER or Med-surg after that I will go to a grad school.. by that moment, my case as a H1B visa will be much easier to get approved by USCIS.

I have 2 colleagues who got approved as a Critical Care Nurse in a hospital in Florida. Got a RFE on my case. Just got resumed last april 6. Hoping for my approval pretty soon.

While many hospitals stated "preferred BSN" is not required. I would find it difficult to find a hospital in the state of Florida that had all BSN nurses in critical care. I also see posts in the Florida forum where US nurses are finding hard to find jobs.

H1B is usually for advanced practice nurses or " speciality units" a BSN does alone does not qualify a nurse for the position alone, it is nursing expertise which is demonstrated by years of experience ( usually 3 or more full time) and a certification in the field. Also the BSN should be equal to a US BSN, meaning there credentials were reviewed by an educational center, which qualifies US degrees.

I am not doubting your friends got approved, if they don't have the above qualifications I am guessing the hospital is electing to circumvent US law, by taking International Nurses who will have to abide by conditions that US nurses won't tolerate. I also wonder if they are offering qualified US nurses a bonus ( the cost of recruiting and hiring nurses on H1B). I am unaware of any hospital offering US nurses signing bonuses.
