Be very careful of even considering using that I-131, it does not guarantee that immigraiton will let you back into the country and states so right on the document that you received from them. I would only use it for an emergency. Anything else and you are playing Russian Roulette. It is purely at the discretion of the immigration officer when you arrive back and I have seen some refused.

Suzanne, i have asked you about I-131 before, and you said that as long as you have a proper document, you will be permitted to travel out of the country. Now you say that AP does not garantee entrance. With this answer of course no one wants to put their case in jepordize.

But I think there should be reason to be denied to enter the country.

I think what Suzanne was trying to say is that immigration officers are becoming more stricter nowadays for several reasons and nothing can be guaranteed. Better safe than sorry. Rules and policies change easily re: travelling in and out the US and it's territories and U.S. immigration officers always reserve the right to deny anyone initial entry or re-entry.

I even know someone who have a tourist and has been going in and out the U.S. for decades w/ no hitches but when an immigration officer suddenly found a new trend on his travels he was questioned or interrogated for almost 2 hours before the officer finally decided to let him in. There are red flags that immigration officers see that others don't see.

Just called my mom and we both felt it might be better to wait till receiving the green card for me to go to visit her. So grateful for her understanding (we have not seen each other for a long six years) and that took a lot of pressure off.

I also just got an email from USCIS said that my I-765 was approved. I guess I will just try to start working first and wait a while. If it is not going to take too long (more than 1 year) for I-140 and I-485 to go through then I will just wait.

I have one question here, MY I-140 is approved and I-485 is on it's way, Is it possible for me to work under different Employer using my EAD if my employer who filled I-140 has no objection? will it hurt my GC processing?

Please advise!.

Your primary employer should be the one who was sponsoring your LPR. I was told that you can also have a part-time job somewhere else if you want to. I am not sure how solid is my information. But I would be confident to say that you may get yourself in trouble if you use your EAD for different full-time job.

Hi,

If you'll be able to submit the requested docs within the time frame, you will be all set and your pending I-485 will just remain in the backlog until visas open up again. Otherwise, you will receive a notice of "intent to deny" from USCIS and this notice is already a prelude for denial (this is according to my lawyer). Hope this helps.

thank you so much for the info... i'm trying to work out my VSC and they're just waiting for my IELTS results which I will be taking this Dec 2, 2006.. I am just hoping I'll pass the exam...

all other documents are already submitted to ICHP/CGFNS...

hi

your was soo fast

I submitted the form on sept28,2006 and my I140 hasnot been approved yet.

hope u will get ur gc soon.

good luck.

hi seiko5...

good luck to you too...

don't worry you'll be fine...

even if everything was approved on my case, still my GC won't be on my hands yet because of the retrogression... we'll all be having those GCs all at the same time...:nuke:

I just want to clarify one thing:

1. Did you receive your EAD card, your I-140 approval and your I-485 RFE at the same day - 11/20??????

If you do, that is really unusually unique case (at least I feel that way)

As far as what happens after you submit your documents for I-485. No one knows. My documents the received on Nov 1. No approval yet. I believe until the next quota is released (if there is any), nothing will be done. But who knows. All we can do is hope and pray.

Happy Thanksgiving everybody!!!

:balloons: :balloons: :balloons: :balloons:

as for your question, yup I received my EAD card, my I140 approval and my I485 RFE all at the same day and same time-Nov 20, 2006....

I, too, was feeling unusual about it... My lawyer told me that I'm very lucky because the processing of my papers was soooo fast.... But still, no GC will be released for me until retrogression be lifted... *sigh*
