i just wanted to start a thread about adjustment of status(aos) for those nurses who are alreday in the usa on some other non-immigrant visa and going for aos.
1.after applying for aos(i-140 and i-485 is filed together, i believe) how long does it take for the ead to come?i had heard that it is within 90 days but somebody told me that we will not get ead until the i-140 is approved. how true is this? some of my friend got ead within a month of filing.
2. does that approval mean we will get the green card right away? what i have understood is for those who are going through consular processing, after approval, the document is sent to embassy and teh applicant has to wait for the interview date and medical check up..then the visa is issued. but for aos, i think interview is generally not done..then what is next after i-140 approval?
3.do they touch the i-485 application only after approval of i-140? i can see that the processing dates for aos(i-485) are different than processing date for i-140 schedule a nurses..what does taht mean? does this mean taht nurses' papers will also be processed just like other non schedule a category applicants? or ours will be faster?
somebody..please make it clear to me.......
i again have question about the medicals. can i get the check up done by any physicians in the usa or i have to contact the one who has been designated by uscis? thank you.
no, not any physician. there is a specific list of physicians/clinics, that do medical exams for the immigration.
your attorney should have given you that list.
these clinics give you results same or next day.
p.s. i don't know the answer to your previous question.
It usually only takes a few days to get the letter for immigration from the doctors depending on what you need to have done, etc.
It can be sent now, but nothing at all will be done with what your attorney was in a hurry to send, without a medical being included. They definitely did not save you one day of time. The medical must be included for the EAD to be processed, and that is what your concern should be with. None of the other issues mean anything at this time, you cannot begin to work without the EAD in hand, and the SSN#.
Dominion,How is this fingerprinting done? Do they send you a letter telling where and when to come? Or you can schedule your own timing after getting the letter?
Thank you.:)
USCIS schedules the fingerprinting for you. You will receive a letter from them showing the USCIS Support center, address, date and time to go do the fingerprinting. Make sure you have an identifying document like state ID.
They also take a picture of you .....so you might wanna look good!
congratulations enfermeria! that was pretty fast. well, i hope mine goes fast as yours. my i-140 was approved on jan 16 and i did fingerprinting on feb 01. i also sent in all required documents and service center was texas.
hi dominion, my case was approved "three" weeks after fingerprinting... so i think you are in good shape.. just wait for approval.. i guess.. good luck.
yes you did answer all my questions. thank you very much. yes, texas is very fast. congratulations to you. i am happy for you.i am using vermont service center. just sent the documents few days ago. how many days does it take for the receipt number to be sent? does uscis send an e-mail or just mail the letter to the attorny?
can we track our case with that receipt number or we have to wait until we get a visa number? i also had everything ready(including visa screen) before sending the documents to uscis. but we did not send the medicals ....will that matter? my attorney said it can be sent later....i think uscis will send a rfe for that..
starbin, if you look at the uscis website. medical exam document(i-693) is a required document at the time of filing i-1485 .. please submit it asap..look on uscis for approved medical centers which will provide you medical exams... .http://uscis.gov/graphics/formsfee/forms/i-485.htm

thank you enfermeria,
how about the travel document? is that sent before the ead or it takes time? what if i am in an urgent need of going abroad..and i haven't yet gotton the ead? can i just leave usa and come back without the advance parole(travel document)? i am on h4 visa.

i applied for travel document at the same time with other document. as i mentioned before, i filed everything at the same time.
i received my travel document 5 day after ead card. only about 3 weeks after filing the documents.
the most important thing is to send medical document in asap.. i don't know whether they will process your application without it or you will get rfe for it.
i don't know about h4 visa, though. sorry...
a person i know recently went out to asia with h1 visa and she didn't have any problem coming back to usa. just make sure your visa is not expiring soon.. i guess... i think the best thing is to just wait for travel document... i should not be long before you recieve it...but since you use vermont service.. i don't know about timeline for this though...
hope this helps.. good luck..
