i just wanted to start a thread about adjustment of status(aos) for those nurses who are alreday in the usa on some other non-immigrant visa and going for aos.

1.after applying for aos(i-140 and i-485 is filed together, i believe) how long does it take for the ead to come?i had heard that it is within 90 days but somebody told me that we will not get ead until the i-140 is approved. how true is this? some of my friend got ead within a month of filing.

2. does that approval mean we will get the green card right away? what i have understood is for those who are going through consular processing, after approval, the document is sent to embassy and teh applicant has to wait for the interview date and medical check up..then the visa is issued. but for aos, i think interview is generally not done..then what is next after i-140 approval?

3.do they touch the i-485 application only after approval of i-140? i can see that the processing dates for aos(i-485) are different than processing date for i-140 schedule a nurses..what does taht mean? does this mean taht nurses' papers will also be processed just like other non schedule a category applicants? or ours will be faster?

the approval of i-140 doesn't mean that your green card is approved or will be approved right away.

after i-140 is approved i think we wait for the fingerprint letter.

ans question #1: my ead came 2 weeks after filing application. the start date on my ead card is before the approval date of my i-140. also, my i-140 is approved after they mailed my ead card. therefore, ead card can be processed before i-140 approval.

ans question #2: greencard will be issued only after approval of i-485 (aos).

i think you understand correctly about consular processing outside usa. for my case (adjustment of status), the greencard was mailed about 1 weeks after online approval status. no approval notice mailed until now. no interview. no infopass for passport stamp. no rfe (request for futher document). for aos, after approval of i-140, they will schedule you for fingerprint and photographing and might send you ref notice (if they need further documents from you for processing i-485). interview is possible, not probable. according the info i searched only, for employment-based adjustment of status, only 5% of applicants are selected for interview.

of course, the different processing dates for i-140 and i-485 is due to the fact that they are different applications and belong to different steps of immigraion process... and possibly processed by different department.

my cases were received in the being of october 2005. greencard received at the end of jauarury. my processing time is about 4 months.

please note that the processing time and application process differs by service centers used, and type of cases and whether you submitted all documents they need in timely manner.

i think my case it quite fast becuase i submitted all required document (including visa screen) at one time and use tsc, which is "currently" faster than some other service centers.

i am using vermont service center. just sent the documents few days ago. how many days does it take for the receipt number to be sent? does uscis send an e-mail or just mail the letter to the attorny?

can we track our case with that receipt number or we have to wait until we get a visa number? i also had everything ready(including visa screen) before sending the documents to uscis. but we did not send the medicals ....will that matter? my attorney said it can be sent later....i think uscis will send a rfe for that..

congratulations enfermeria! that was pretty fast. well, i hope mine goes fast as yours. my i-140 was approved on jan 16 and i did fingerprinting on feb 01. i also sent in all required documents and service center was texas.

the attorney that we use, that has such fast results, requires that the medical be included. especially if you are waiting for the ead, it will not be sent until the medical results are in your file. and you need the ead before you will be able to work.

don't worry about receipt number, what you should be concerned with is how fast that you will receive permission to work.:)

Starbin, send your medical right away. That's one of the first things they will be looking at.

The receipt can take a week, or two or three.:specs: Your attorney will receive it.

Once you get it, then you can track your case online.

how is this fingerprinting done? do they send you a letter telling where and when to come? or you can schedule your own timing after getting the letter?

i will send the medicals very soon. we did not send that with the other applications because we thought it could delay filing since the report would take about a week to come...but now, i think i further delayed it by not sending..he... he...he..

but can that be sent now without a receipt number or without rfe ?
