EMPLOYMENT-BASED VISA AVAILABILITY DURING THE COMING MONTHS

from the DOS website: The current level of demand in many of the Employment-based categories has been MUCH LOWER than anticipated. As a result, the June cut-off dates have been advanced significantly in an effort to maximize number use under the annual numerical limits. At this time it appears likely that there will be additional advances during the coming months.

this is great news for all of us waiting for visa numbers and for all of us who thinks that the CIR bill is the only way to get in immigrant visa.....let me remind you that the dates moving forward is NOT always the case. Visa numbers can retrogress and go back a few years as what happened before but this gives us a glimmer of hope

how to use the Visa Bulletin chart. example: if a Philippine-born nurse files his/her I-140 BEFORE JUNE 01, 2005 it means that an immigrant visa number is available for you and your family and processing will continue. This is applicable for both Consular Processing and Adjustment of Status.......

Just keeping my fingers crossed that everyone else soon has good news as well. Roll on July's bulletin.

How long will it take for a consular interview to be scheduled if one is already "Documentarily Qualified"(as per the US Embassy) and PD is already current?

What many of you are failing to understand, just because your PD date was before the new cut-off date, you still need to go thru the same process that you would have to go thru at any time before you will get an interview date. That means the visa bill being paid, the DS-230 being submitted and approved, and then the file being completed before it is sent to the US Embassy for your interview to even be scheduled. So for many, this is not going to change things. It can still take months and months to get to that point.

And until they actually go thru and see how many that will be getting visas with the new dates, I do not see them making changes for the Visa Bulletin for July. Remember that this information that you are seeing is for June, it is not even in effect as of yet. US Immigration actually is not operating at full staffing right now either, something that more of you are not even aware of. The centers in the US are operating at much less than full staff, and this is for the offices where people have to go if they are in the US.

You still must have a completed file before you will be scheduled for an interview. Never before that point. And the next issue is that many agencies, if you are under one, are not wanting to do anything until they know when things will end. And for those of you that have PD dates from two years ago, it means that there were problems with your agency and or attorney to begin with. Definitely, not the fault of the US Immigration offices. You should have had a green card by now and be in the US. Correct information was not submitted, and or payment was not made when required, but you will see US Immigration being blamed by the agencies, but that is not the case in most instances.

Until visas are actually current for all, and that is not going to happen until there are more visas additionally recapped, etc. That is not going to happen for months. Andn there are more waiting for visas than there will be visas available, no matter what they do. Dependents currently get a visa from that group of visas.

We were upto DS-230 when retrogresion hit. We are one of the lucky one's my PD date is May 2005. We understand we have to continue along the same time schedule as before, but at least we are moving ahead. It was welcome news that the dates advanced from 2003 to 2005 (for UK nurses). From when we were retrogressed the date up unitl June's bulletin had not moved, we were all clinging to the hope the senate would pass some bill for immigration reform or recapture of visa's, up intil this visa bulletin the senate was our only glimmer of hope. This bulletin was both unexpected and extremly welcome our hope is renewed.

Roll on July's bulletin.

But again, US immigration right now is not operating under the same staff that they were using a few months ago, so things are still going to be slow. And until they know for sure how many visas will actually be used, do not expect them to make increases in the PD immediately. These new dates to not even go into effect for two more weeks.

Sorry, to be like this, but these are the facts of what is happening in the US right now.

Refers to an immigrant visa applicant who has: 1) returned Form DS 2001 (from the Instruction Package) to visa-issuing post (or in some cases, to the National Visa Center), OR 2) informed post in another way that he/she has all the documents for his/her immigrant visa application, and the post has completed its clearance procedures.

Does it mean that anyone who is already "Documentarily Qualified" and with a current Priority Date is just waiting for the notification for consular interview?

Yes it is good news, however as Suzanne has mentioned it is important to keep in mind it is only a small hole in the wall....this is so that no one gets false hope that it is still going to happen overnight. For those of you waiting for so long there is and has been issues with processing your cases... immigration sets the rules, if the submissions are not completed correctly they are sent back... things must be according to how they want them. I have seen where a paralegal has submitted the doc's and made mistakes (not intentional but it did cause someone to wait much longer), some agencies hold off sending documents in so they can market the RN's and this gives them time. It is not often that immigration loses things but they did loose my file.. I would say I am not the norm. Things change like the need for a long form birth certificates that can take months to get.

I think that we all need to look at being optimistic but not going out and purchasing a plane ticket and packing your bags. Balance in all things will save you all stress and worry.

This is a small move forward and any movement is very welcomed.. just temper it with a little caution.

I know Suzanne really cares about all of us and tries to provide us all with the best information to make your transition smoother... so patience all, it will come to pass and it will all be worth, especially if you do it right..

Never Ever Give Up!!! It is like studying for the exam it is painful, but oh how sweet it is when you have worked hard and then you pass...
