My opinion is that nobdy should be jailed unless they caused physical harm to another person, since being jailed precludes them working, supporting dependents, paying fines, paying taxes. And also that anyone who physically hurts another person needs to be jailed for a long time, without parole, and then be on probation for life. Since I don't know what her history is, I can't determine which category she falls into.

Karl Farmer; drug dealers cause harm when their victims turn out to be physically addictied and go off to steal to get the drugs ... there are other scenarios where the crime doesn't directly cause physial harm. Also, Bernie Madoff didn't physically hurt anyone ;). I agree with you to a certain extent.

Don't forget, this is Texas! All crimes are punished with lethal injection by default (by some guy named Baba wearing hunting camoflage and muddy boots, smoking a cigar, and a bottle of Jack Daniels in his back pocket) unless your lawyer can plead the penalty down to anything with a life expectancy. I once got off on a speeding ticket, but they said the prosecutor was having a bad day.

well, she won't have a job so won't be paying her fine, or income taxes,so the state will have more expenses and less revenue. aside form that, in texas, you serve only one month for every year you are sentenced, regardless of the crime (so a ten year rape sentence means you are out and free to rape again after ten months), so that explains why she has 'at least three prior' convictions.

this story brings back an incident two years ago last month. a man made an illegal u-turn in boulder hwy in las vegas, nv. he lost control of his ram 250 truck, and took out a steel bus stop. unfortunately, my sister-in-law was sitting at the bus stop and unable to get out of the 3 sided bus stop enclosure. she saw him coming but was able to throw her body across a young nurse who was also waiting for a ride to the 7 am shift at the local hospital. the nurse's legs were immediately amputated and my sister-in-law patricia ann hoff had internal injuries. pat insisted that the nurse be transported first but pat died on the way to the hospital from internal injuries.

the driver had numerous previous duis in texas and had previously done time in a texas prision for the same problem. once he got out, he moved his family to nevada, and because he did his time, had full driving privileges in nevada. unfortuantely, he started using various pain killers (oxycotin and 4 others pain killers were found in his system when his blood was drawn). at the time of the accident he was on his way to his construction job but he was illegally driving because he had a limited license. he is now doing 19 years to life.

allegedly, he was taking the meds for a back problem. i am certain dui laws were not designed to enable someone with a severe drug problem to continue driving, but once he got out of prison in texas, his record was wiped clean. i am just as certain that when he kissed is wife and kids good by at 5 am and got into his heavy duty red ram truck, he had no intention of harming anyone. he did, my sister-in-law died, a nurse is without her legs, and the women's children are without their mother. three families have had a severe loss (the driver's, the nurses', and my sister-in-law's).

both, obviously the first DWI didn't get her attention. Addiction does mean massive denial and poor judgement, impulse control....in a prison cell with an alcohol treatment program and support, she might just have that "come to Jesus (or Higher Power) breakthrough...or not...Lindsey Lohan, not yet anyway, Robert Downey Junior...looks like it.

I have one DUI, and it has ruined me for life in many ways. Anyone that has one DUI, who would even have a fleeting 'thought' of driving again ever again, even after having SMELLED alcohol, is not able to be helped. The consequences are so severe, that it is breathtaking. This is my opinion. But my situation is one of being a rare alcohol drinker, as well as a rare driver, who was nabbed in a prefect storm. No injury, no property damage.
