i'm really depress right now.i am a tourist visa holder and i'm here in US at the moment,i finished all my exams already including nclex and ielts and this freezing of visas really ****** me off and i'm losing hope already.do u have any idea when it will end?is there a possibility that visas for nurses will be available this year?i really don't know what to do.regarding the issuance of working visa is there such a thing can my employer issue me a temporary working permit?it confuses me a lot. i did apply for student visa cause my lawyer advice me to enroll in a school to extend my stay here in able for me to find an employer once the visa will open.my dreams will all be gone in trash.
I badly needed some replies here.i'm desperate wanting work already so i can support my family and myself:(
But they can not stay in the US whilst waiting. If their tourist visa is expiring soon and they haven't gotten sorted with F1 they need to consider returning home until things are sorted. Yes it is worth considering and the member has posted in other threads regarding Australia and Canada but still is going to take time and coming to the US expecting to be able to AOS isn't fair on the ones that have been waiting several years
You came here asking the question "when will retrogression end?"You asked for advice from your fellow nurses, and you have received responses from numerous people.
Unfortunately, the responses you are receiving are not what you want to hear, and you seem to be dismissing them. No one is going to tell you that there is an easy way for you to stay in the US and work--not with a student visa, not with a tourist visa--because it is not possible at this time. You also mentioned the possibility of a fiancee visa, and unless you actually have a fiancee, that would be considered fraud and will get you deported.
Your situation is not unique. These boards are filled with people who want to stay in the US with a tourist/student/fiancee visa--basically any type of visa they can lay their hands on! Many posters think they "have to work," and are looking for ways to stay in the US rather than going through the proper immigration procedure. Everyone thinks their situation is special, but most are not. Just because you are currently in the US doesn't--and shouldn't--give you any advantage in terms of immigration. People wait years for their opportunity to immigrate, and the ones who wait are the ones who should be first in line.
I would encourage you to do some reading--a lot of reading--on these boards. You will see that many people are in the same boat as you are. The US economy is faltering, and US nurses are losing their jobs. The priority is for these nurses to get back to work. Petitioning foreign nurses when US unemployment is rising makes no sense at all. Many people mention their "faith in God," and "praying for a miracle," but refuse to look at the reality of the current situation. Prayer is fine--it gives a lot of people comfort--but it's not going to end the retrogression any time soon...
I agree 100%. The Retrogression might last 20 years or more if the crisis is not resolved or no legislation is created to let more nurses in. Prayers were not designed to benefit only those already in the USA, but also those waiting in the PI. Unfortunately hope, optimism and prayers don't change the Retrogression. If there's any fairness left, it should be that those standing in line get visas first rather than people trying to cut in front of others by doing illegal stuff like using a tourist visa not to tour but to find a job.
i don't want anyone to get offended here and sarcastic replies will not do any good.i'm just discussing my own problem and i'm just suggesting views from you guys.don't take this too personally.this is a case to case basis and mind you that PRAYER CAN CHANGE EVERYTHING!Green jungle and jfrn:I am not selfish and i am properly educated regarding this matter.I am just ranting based on what i am experiencing right now!and also the immigration granted me a b2 visa you can't blame me in hoping that I might get a working visa soon but in GOD's help i know i can survive this! god bless you!!!!
You are so correct, prayer can change everything....US citizens and legal residents who are currently living in the US are just doing that....they're praying to obtain a job....and as Obama has stated in his speech "I'm working for the American people"...He will work at getting the economy back up for the "American People"...
While you're waiting for your slim chance at a visa, what is your back up plan? Are you currently working and gaining experience?
I am here in las vegas and my mom who is also an RN here will support me in my financial needs. By the way you can travel outside US while you are in a student visa and that is one of the scope of f1 depending on breaks. I have doubts in returning home cause my b2 visa will expire soon and there is no possible way that the US embassy will issue me another multiple entry. This is really a risk that i have to take, most of my friends here are doing the same, the f1 processing the least is 1 month and the most is 3 months. We cannot control the situation.Visa is also a lottery and more on LUCK!
Actually, if your application get approved, you will get F-1 STATUS, not F-1 VISA. Two BIG differences. F-1 status does not allow re-entry into the US. You need to apply for F-1 VISA in the US consulate in your home country for that. And chances to get F-1 visa in the Philippines for the language school are close to the absolute zero. Even with USCIS approval.
I know some people who have been living in the US for over 10 year in F-1 status. During all this time, they could never go home to visit their friends and families because they know that their F-1 visa applications will most likely get denied.
oh my this is really tough for me.anyways, I already applied for student visa right now and by any chance I'm just hoping this will end soon.I know there are still many nurses who are waiting for their visas and might as well i am in the end of the queue at this moment.I lay down all my options and in case retrogression will not resume anytime soon, the only way i have in mind is fiancee visa. This situation really stresses me out. I thought I am capable for h1b.All I can do is to PRAY!Thanks for all your replies, I know I'm not alone who is experiencing the same problem, all is affected.
If you have a fiance who is a US citizen, that's a good start. You can adjust your status by marrying your US citizen fiance. F1 student visa might work to buy time without incurring unlawfull presence which is subject to three to ten year bar. Take note of the word "unlawfull presence" because it can derail your plan even if the unlawfull presence is only for a day. The transition from B2 visa to f1 visa can also be very tricky when determining if there's unlawfull presence incured. Nobady knows when the retrogressions gonna end but if it does end, it's gonna be a mad scramble to the finish line. If you incur unlawfull presence by overstaying, it can only be forgiven by marrying your US citizen fiance. Adjustment of status by any other means will not be permitted and you'll be subjected to the three to ten year bar if ever you end up in the Philippines. We don't know what Mr. Obama's plan are for the future of nursing. If there's a bill in Congress, we don't know what the final outcome will be and the specifics of it until the president signs the bill into law. If your intent is to stay in the US for good, the only viable option is to marry your US citizen fiance even if you overstay in the US. The other option is to transition from B2 to F1 hoping to buy time in case the President signs the nursing relief act into law where you can adjust your status in the US. The third option is to go home without incuring unlawfull presence therefore preserving future immigration benefits and also avoiding the three to ten year bar. You'll be walking in a tight rope and it's really a gamble. I hope you make a wise and reasonable decision.
are u sure that it will last for how many years?i have no choice but to stay here.i already have a sponsor right now the problem is the VISA!o god help me
i am also here in las vegas. what part are you?? i really hope you can find solution to your problem.
