I recently gave in my letter of resignation. I gave them 5 weeks notice (I still have 2 more weeks to go) Yesterday I called out sick. I am now being told that I won't get paid for that day because once you put your letter of resignation in, you can't use your sick time. I have sick time in the bank. Is this legal?

If you have a union I recommend talking to your steward or calling the union directly. If not then ask the human resources dept. for written documentation of this policy.

it depends on the hospitals policies.Call human resources get a copy of staff polices and benefits. Sometimes they change and for what ever reason we might not know it.

One facillity I worked at the policy stated no sick time would be paid after the letter of resignation was turned in. This was to keep employees with lots of built up sick time from calling in during their last days on the job.

I am not sure about the hospital I work in now, but I remember at the nursing home I worked at prior to this, you had to work all of your hours in your last 2 weeks (or whatever amount of time you gave notice for) or you would not be paid your accrued vacation, etc. This included calling in sick. It was in their policy.
