Question about retrogression

Hi to everyone,

I just joined this forum. Im from Manila.Id like to get some updates about the retrogression of nurses in USA. Is it possible to to apply for H1C Visa while in the process of applying EB3 Visa? Thanks.

50,000 visas are for nurses and physical therapists, but family members are also counted in this number. If you take into account that many nurses who wish to emigrate are married and have at least one child, then the number of actual visas open to nurses is cut down to about 16,000.

That is something that they are not saying...........so this number is not going to make that big of a difference, it will be the most helpful to nurses that are already in the US but who haven't been able to file documents yet.

Congress passed this, and the President signed the bill for these extra visas, but Immigration has not acted on it and it can still be at least weeks or even months.

#1268 was tacked onto an appropriations bill for aiding people in Tsunami hit regions as well as more funding for Iraq, etc. Things were not fully addressed, other than the release of the 50,000 visas.

As I just answered to your other post, the retrogression is not going to be over for some time. 50,000 visas is only a bandaid fix. Immediate families are included in this number, so actual nurses covered are only going to be about 10,000 to max of 15,000.

The current date for immigration is still 2002. Do the math. Look at how many are already waiting. This amount is not going to cover everyone from the PIC countries. Read some of the recent posts from Rep. His perspective is quite "right on the money."

They have just starting working on the petitions that were filed already, and just in the past few days. So it is going to take them some time to get caught up. Just sit tight, and yes you were under the retrogression........you will just have to wait to receive the next documents form them, and also be aware that there is usually a backlog at the US Embassy in Manila..................

hi suzanne,can you tell us which process now in this age of retrogression would lead to an earlier acquisition of a green card: adjustment of status here in the USA once the visas become current, or going back to Manila and be included in the backlog at the Philippine Embassy? They say that CP is faster than AOS. Please enlighten us.

Normally, you can begin work faster if you are in the US and have an AOS processed on your behalf. However, with the retrogression in place this is at a halt, but so it any other type of petitioning. The length of time to actually receive the green card should be about the same. The AOS just lets you begin work in 60-90 days vs. one to two years on average. But not sure what they are eventually going to do about the AOS, as many visas are being taken up this way, even from other countries....So down the road they may make a change to this rule.

Not sure what to suggest to you right now as no one knows how immigration is going to handle these 50,000 visas..........Sorry...........

Hi, am new in this discussion. can anyone help me on this? My packet 3 was already sent to NVC last April 2005 and my agency in new york told me that it will take 4-6 months to get my visa...can anyone comment on this? is this good to be true? can anyone share the step by step procedure on the GC process thru EB3? From I140 - to getting the visa? Thanks in advance!

It will take you much longer to get the visa, if you meant April, 2005. The retrogression is still in place and there has been no word as to when dates will be considered current.

There are already several threads here detailing the process for immigration. It will be much easier if you just do a search........... :)

Hypothetically, if the PD is current already and retrogression is lifted,will the 4-6 months timeline given by the agency feasible? Upon submission to NVC, how long will it take to have a schedule for a consular interview? again provided retrogression is lifted?

Without the retrogression in place, it takes about one year from the time that you receive initial approval until you have your geen card, provided that all of your documents are in hand, inlcuding the Visa Screen Certificate, and you are petitioned out of Vermont office. Sometimes can be just alittle quicker, and other times just a little slower.

But be aware that even if the retrogression lifts tomorrow, there is still a tremendous backlog that needs to be processed...............
