Question about retrogression

Essentially in one word: NO.

Extremely few hospitals even offer the H1-C due to the amount of paperwork involved. The areas that they are in, location and gang element should be a deterent to anyone. I do not even know of any immigration lawyers that would try to place someone with one, if they are reputable at all.

You still have the same requirments as you do for the green card.............

Have you completed all necessary documentation needed for your green card, and have a Visa Screen Certificate in your possession?

Other major problem of the H1-C visa, is that you are essentially owned by the hospital. If you do not like the facility, and want to cancel, you will have only x number of days to find another facility to sponsor you in this category and that will be extremely hard. Not worth the trouble in my opinion. For what it is worth. Same goes for H1-B visas.........But they are not currently available to RNs right now.

Any updates regarding retrogression? How true that by July this year, retrogression will be lifted?

Do you have your papers already filed, or are you just beginning the process?

If your papers are already submitted, I aam hearing form my immigration sources that those are beginning to get processed again. However, if nothing has been filed yet, the retrogression is still in effect.

My petition was filed on April 14 2004 (My Priority date) and approved on July 2004 ( Vermont Center). I completed all necessary documents and acknowledged by NVC on January 2005. The NVC informed me to wait for further instruction after eight(8) weeks. As of this writing ,the NVC had not given me any instruction of what to do next with the processing of my petition.( Its more than 8 weeks already) My state destination is New York. Am i still in the right track of processing the petition? Do I have to wait longer because of the retrogression?

They have just starting working on the petitions that were filed already, and just in the past few days. So it is going to take them some time to get caught up. Just sit tight, and yes you were under the retrogression........you will just have to wait to receive the next documents form them, and also be aware that there is usually a backlog at the US Embassy in Manila..................

05/04/2005 HEALTHCARE IMMIGRATION ALERT:

RETROGRESSION LEGISLATION: DONE DEAL!

The deal between the House and Senate to recapture unused immigrant visa numbers and eliminate retrogression was finalized late last night. The deal creates a special EB3 immigrant class for Schedule A occupations -- registered nurses and physical therapists. The special class exempts 50,000 immigrant visas from the general EB3 category and effectively ends nurse and physical therapist retrogression for at least the next two or three years.

It is expected that the formal enabling vote will take place next week. The President will sign the legislation shortly thereafter. It may take the Departments of State and Homeland Security several weeks to apply the law. At this point HLG estimates retrogression will be effectively lifted for EB3 Schedule A occupations with the publication of the July Visa Bulletin. The July Visa Bulletin should be released in mid-June.

HLG and its coalition partners, which include many prominent immigration attorneys, staffing companies, healthcare facilities, hospitals, and healthcare advocacy groups have spent several months working with Congressional representatives to raise awareness about the healthcare staffing shortage and push for Congressional action.
