If you had misdemeanors expunged, can a level 2 for nursing find them? Do I let the board know I have them before I sit for my NCLEX? This was almost 10 years ago. Any feedback

I don't know what "level 2" means. All I know is that you must answer all questions honestly. There's no such thing as "letting the board know." It WILL know. You just need to be honest & upfront to even have a chance.

The BON background check will see EVERYTHING. There are rare accessions when things don't show up for some people, but that's not the norm. As for if you need to tell them, if there is a question about misdemeanors then yes. There is for sure one for felonys. But I'm in AZ and there is no question asking if there were any misdemeanors. I have applied for both CNA and just recently RN and asked them in person (I have a minor in consumption of alcohol from 7.5 years ago) and was told no. It will be seen in the background check and they will send a notice for more information if they want it. I never got one.

Just be be honest with whatever is asked. If not, there will be much heftier consequences.

When a criminal background is involved, honesty is the best policy. Believe me, the background check will unearth these issues. You really should inform the board of nursing before you take NCLEX.

The board of nursing can, and will, access sealed records.

They are able to perform an FBI level background check on NCLEX applicants.

It is more important that you show ethically correct behavior by divulging past discretions.

I would get an opinion from an attorney. There is a legal definition of "expunged." You need to see if this applies in your state and seek counsel from a professional possibly nurse/attorney.

My advice is to get your own FBI background check done and find out privately what it shows. I find it very hard to believe a misdemeanor offense that has been expunged would show up on this.

I had a juvenile act from high school at 15, about 10 years ago. I was never convicted of anything, never issued a ticket, never arrested. I had voluntary probation...of course the board found out. The hiccup cost me about 2 months extra waiting time because I didn't disclose it. The board will find out about everything. Someone said they are able to perform a FBI back ground check. They DO a FBI level back ground screen, ASWELL as also having an investigation department. Just words of advice lol

Yes....tell them! I was in a similar situation as you. I am now having to pay $500 for not disclosing.
