I just graduated this year and I am planning to work in California since I already have a tourist visa for California. Is it possible for me to take the NCLEX and IELTS even tho Im not a Local Board Passer in the Philippines so I can go to California to work? Will I still be able to work in California even if I don't have a license here in Philippines?

What visa do you really have? Tourist visa is NOT a working visa. You are not allowed to work in the US using a tourist visa. It is illegal to do that.

Im sorry for that error.. I really meant Tourist Visa.

Im thinking that I am gonna pass the NCLEX and IELTS here in the Philippines then Personally go to an employer in California to petition for my green card. Is this possible even though I still didn't pass the Local Board Exam? Am I eligible to work in California?

Having tourist visa makes no difference as there are no visas currently to AOS and I can't see it happening again for a couple of years. There are threads already on whether you need local license to proceed with your application and I suggest you have a read or use the search facility. I also suggest you have a read on retrogression as you are looking for a few years before you will be able to move to the US. Also many employers at the moment are delaying taking on foreign nurses due to the retrogression

im afraid to say this you might be one fo the candidate if yu go there to takethe exam. some filipino tourist was deported lately after they found out some papers in there luggage.

Taking NCLEX-RN in the US is not a valid ground for deportation, planning to work is.

Having documents which are not subversive in nature is also not ground for deportation, having "pirated" documents is.

It is not a valid for deportation but they will not issue tourist visa to you if your intention to go to the US is to take NCLEX.They will only issue visa to you if you have already applied to take the NCLEX with the testing center as Saipan and Guam but not on US mainland.

you can never tell, because the one who will determine this is the immigration officer , they can question you. tune in to the latest news

The bigger issue is that there are no visas available and we do not expect the AOS processing to open for several years at the earliest if you take into account that there were just 800,000 plus petitions submitted for the I-485 and only 140,000 green cards per year issued for employer-driven green cards per year.

Adn even bigger issue is that there are many here that have been waiting for some time to get the green card under the Consular Processing and for you to want to take cuts in front of them is not the wise thing to do now, even thinking about it is not a good thing.

Be aware that passing of the NCLEX exam and even having a petitioner no longer guarantees that you will get a green card. There are many more ahead of you in line already and less than 10,000 green cards are for the EB-3 category from your country, which means more professions than nurses as well.

Suggest that you do some reading here, the tourist visa if you have one is because you got it thru your parents, not by you applying for it at the US Embassy. Without having a job there, it will be hard for you to prove that you did not have dual intent to remain in the US, and that is actually against US Immigration Law to do so.

Just adding to dave23's post. The fact that there is already a Pearson-Vue testing center for NCLEX in Manila is another reason for an immigration officer to question someone. This Pearson-Vue testing center is also touted to be one of the biggest outside US, so what's the point going to the US. It is a very well-knowned fact that majority don't go back home after taking the exam, whether staying legally or not. However, all these are discretionary, so it also depends on the immigration officer if he spots it but they are trained to do so.
