Missed check in due to hectic work day, immediately emailed my case manger through affinity and BON website, of course it was after 6pm, she emailed me back the next morning stating that I was selected and I missed the check in, and now my license is suspended for 2 years with the LPN board, has anyone had any experience with the board reconsidering? i also tested the next day at a drug site via my employer to show compliance, Btw this is in Louisiana.
Absolutely an attorney could help. I did not have one in the beginning because I was under the sadly mistaken impression that these idiots were there to help me. By the time I found the only ‘help’ they had was helping themselves to the contents of my bank account and so long as they got their money they couldn’t care wether I dropped dead or not. When I started realizing that and got tired of the bullying and the lies and the game playing and the ‘lets make up new rule as we go along and call it policy’, I retained an attorney and let him do the talking. I learned A LOT about this stuff. These programs get away with murder because people are scared of them.
Yeah, you are under contract and you have to abide by what you signed, but so do they. Something I learned is that this stuff is ‘contract law’...not administrative, like the boards...basically means they are beholden to their side of the deal too. That attorney that you need to go get can explain that in much better detail, but in a nutshell, you still have rights. These people depend on you either not knowing that or being too cowed to exercise them.
Look up TAANA. Generally, any of them will likely chat with you for a bit for either free or a very reasonable small fee. If nothing else, you will have some impartial insight as to your standing.

Thank you so much, I didn’t know, they stated in the contract I signed, I waived my right to a fair hearing, going check TAANA now
I have been monitored for 3.5 years and missed checking in once when selected for testing. I think I received letter (or email) but nothing beyond that. I am also notorious for missing checking in sometimes during the holidays, but again, it is not often. They maintain a very exact record but nothing compared to this. I know they do act if more than 2 tests are missed.

Did you have any other areas of non-compliance (missed self reports, medication verification report, meetings, workplace issues)? If so, maybe the missed check-in was the straw that broke the.... well you know the saying. I don't know if this was your circumstances- but did happen to a nurse I know.
