In college I was charged with "misconduct at an emergency". Sounds way worse than what actually happened. I went to Ohio University and there was a fire down the street. I was on my porch and an undercover to me to go inside. I did go inside but then twenty minutes later I came back out to see what was going on and that same officer arrested me. My school wanted me to fight the charges but I would have to hire a lawyer and I did not want to tell my parents so I just plead "no contest" and paid the fine instead. Looking back it was such a dumb move. I am worried that no one will hire me with an expunged record. Does anyone have a similar situation where they actually got hired?

Expunged means expunged. They will not see the record of arrest if it is expunged.

An arrest will still show up on an FBI background check because you were fingerprinted (assuming you were). Even if the record is sealed/expunged. If you are ever fingerprinted as part of a background check, be prepared to explain your story. I had a BON investigator recently explain this to me.

I see from your previous posts that you have not yet completed nursing school. If you go on the BON website, there are a couple of pages about a criminal past and whether or not a person is eligible for licensure. However, the BON will not decide if you will have restrictions on your license until you apply to take the NCLEX exam and/or are actually issued a license. Restrictions on a license may or may not impact your ability to get a job and not all restrictions are permanent. Just like you should never go to court without an attorney, you should never deal with the BON regarding license restrictions without an attorney that specializes in nursing law.

You will definitely have to report the misdemeanor when you apply to take the NCLEX, even if your record was expunged. The arrest will still show up on your BCI report. If you do not report the misdemeanor, the BON sees that as deception on your part.

I was never fingerprinted. I was taken to my backyard and issued a ticket. And yes, I will never again go to court without a lawyer. Dumb move on my part.
